교정의 개선방안과 민간참여에 관한 연구

지구촌 세계화의 네트워킹으로 인한 현대사회의 다양성과 사회풍조의 문란 및 가치관의 혼돈으로 범죄유형의 다양화ㆍ전문화 내지는 조직화에 따른 청소년ㆍ화이트칼라ㆍ컴퓨터범죄 등 새로운 범죄유형의 등장 등 다양하고 지능적인 범죄가 연일 발생하고 있고, 그 결과로 교정시설 내에 수용되는 인원의 수도 날로 증가하고 있는 현실에서 나타나듯이 오늘날 우리 교정이 안고 있는 문제는 매우 심각한 상황에 처해 있다고 볼 수 있다. 행형의 근본 목적이 범죄로부터 사회를 방위하고 사회 질서유지에 있음은 주지의 사실로서 형사사법작용의 마지막 수단으로서의 교정에 대한 중요성이 강조되고 있는 것도 현실이다. 이는 수용자의 처우향상과 사회복귀의 원활화가 교정의 최상위의 목표임을 나타내는 것으로서 단지 범죄자를 구금시설에 수용하여 수용자의 처우나 재사회화를 위한 교육 등에 큰 관심을 기울이지 않는다면 지금보다 더 큰 사회적 문제를 야기할 뿐이라는 사실은 명약관화한 사실일 것이기 때문이다. 교정제도의 제문제를 교정학적 관점에서 살펴보면, 우선 교정시설의 과밀화는 구금시설 수용정원을 초과한 수용인원 증가가 인권의 문제로서 대두되어 국가적ㆍ사회적 문제를 야기하면서 교정교화에 대한 전반적인 신뢰감 등의 상실로 나타나 국민들의 교정에 대한 부정적 인식을 초래할 위험성을 내재하고 있다 할 것이다. 과밀수용의 문제는 사회의 변화와 매우 밀접한 연관성을 가지고 있다. 과밀수용의 문제는 비단 우리나라만의 문제뿐만이 아니라 전 세계적으로 심각한 문제로서 각국의 교정행정에 무거운 부담으로 작용하고 있다. 교도소 내에 수감되는 수용자의 증가와 미결구금시설에 수용되는 수용자 등의 증가는 구금시설 수용환경의 악화와 교정사고의 증가, 교정공무원의 업무능률 저하 등의 원인으로 작용하여 교정의 궁극적 목적인 범죄인의 재사회화를 가로막는 장애물로 나타나고 있다. 이에 대한 방안으로 교정행정의 개선이 이루어져야 한다. 교정제도는 우선 형사사법행정의 관점에서 그 해결방안을 모색해 나가야 할 것으로 본다. 그 다음으로 우리 교정의 발전적 앞날을 위해서 수용자의 인권개선에 노력하며, 국가적 차원에서 보다 많은 관심과 재정적 지원이 있어야 할 것이다. 국가적인 해결 노력 외에도 교정교화에 보다 많은 민간 참여가 이루어 질 수 있도록 보다 심도 있는 학문적 연구와 체계적인 교정정책의 개발이 필요한 시점에 있다할 것이다.

The international society of 21C have been meet in the change of globalizational era with the wave internationalization and openness at very fast speed. Our country should follow this trend to contrive the changes in economical and social multiplicity. Because of networking in global internationalization, multiple kinds of intellectual crimes have been generated everyday like computer crimes, white-color crimes and juvenile crimes according to the systematic, professional and diversified crime types of multiplicity of modern society, disorder of the trend of public opinion and the erosion of traditional values. As a result of it the people who are in custody like a correctional institution are increasing more and more. It means that our correctional problems are at a crisis like a serious situation a lot. The basic purpose of the execution of a sentence is to protect our society from crimes and keep the balance of order and the last method of criminal law’s effect is still emphasized. It means that the improvement of prisoners’ condition and returning to the society harmoniously represent the further goals of corrective training. If we are not concerned about the education of resocialization or prisoners’ condition which is about someone who is at custody as only a criminal, it is very sure that there bring about a lot more big social problems than now. When we go over the problems of corrective system in a view of reformation, above all overpopulation of a correctional institution is that the increase of the number of people to be admitted exceeded the fixed number of people as a kind of the problem of human right. That is why the dangerous sense which leads to negative cognizance of people’s corrective training which represents the loss of general belief and trust about reformation and enlightenment leading to national and social problems. The problems of overpopulation is highly close to the change of society. It is also our problem even the world, so each country have been operation the heavy burden of corrective administration as a serious problem. The increase of prisoners in custody and in an unconvicted confinement facility operates as causes about environmental corruption of confinement facilities, the increase of corrective accident and the decline of business efficiency and then it is an obstacle to keep criminals from resocialization which is the ultimate goals of corrective training. That is why there has to be the improvement of corrective administration. The corrective system has to search for the ways to solve those problems above in a view of the administration of criminal law first. Next, we should make an effort to improve human rights of prisoners and have further interests and monetary support for our developmental future. Except national solution, we should need to development of corrective policy and further scholar studies to let the private citizens take part in reformation and enlightenment. We should comprehend all the causes of the problems due to overpopulation of correctional institution in the operation of correctional institution and the view of criminal policy and then we are in a hurry to analyze it systematically and correctly about the realities of correctional training in Korea to manage a reform measure.
