핵물질 불법거래 실태의 문제점과 대응방안

Problem and Responsibility of Illicit Trafficking with Nuclear Material

2012년 3월 서울에서 개최되는 핵안보 정상회의는 핵물질과 방사성 물질의 관리, 핵시설의 방호, 불법거래 방지, 핵안전과 연계된 핵안보 이슈, 핵안보 관련 규범ㆍ정책ㆍ제도ㆍ기술적 사항이 포괄적으로 논의되는 국제안보 분야 최고의 정상회의이다. 기존의 핵테러 및 핵안보에 관한 주요사항과 테마는 테러리스트들에 의한 다중이 용시설 파괴나 주요 인사들에 대한 테러로 국한되어 있었고 이에 관한 선행연구가 많이 이뤄지고 있지만, 핵테러 또는 핵안보를 위협하는 원천요소인 핵물질의 불법거래에 관한 논의는 거의 전무한 실정이다. 테러범죄는 테러행위 형태의 추상성뿐만 아니라 어느 범죄행위든지 기회나 비용대비 그 파급효과가 큰 것을 범행의 도구로 삼기 마련이다. 따라서 핵테러는 기존의 어느 테러유형보다 실행행위로 나아갔을 경우의 파급효과보다 크기 때문에 핵테러와 관련된 핵물질을 원천적으로 봉쇄할 수 있는 사전 예방이 매우 중요하다. 이 연구에서는 핵테러의 예방책으로 핵물질 불법거래를 차단하기 위해 국제원자력기구(IAEA)의 ITDB 자료를 바탕으로 무기화로 가능한 핵물질의 보유현황과 핵물질 불법거래에 관한 보안상황 등을 살펴보고, 국제협력방안이나 법ㆍ제도적 대응방안을 살펴보고자 한다.

Existing nuclear terrorism and nuclear security on the key points and themes be restricted to multi-use facility for the destruction or VIP on terrorism by terrorist. Also many article exist these theme. But There is nothing to discuss about illicit trafficking with nuclear material. Acts of terrorism, as well as any opportunities or cost any criminal conduct by its effect as an instrument of crime complaining about big things are bound. Thus, the type of nuclear terrorism to run than conventional terrorist acts which have gone better if the type is larger than the ripple effect, because possession of nuclear terrorism have enough material that can be run from its source to inhibit proactive is very important. In this study, prevention of nuclear terrorism as such in order to block the illegal trade in nuclear material, the International Atomic Energy Agency (IAEA) based on data from the ITDB possible weaponization of nuclear materials and nuclear materials holdings and examine the security situation on illegal trade international cooperation and legal and institutional countermeasures will be discussed.
