A Study on the Electronic Commerce’s Legal Problems - With Emphasis on the Electronic Money -

The realization of the Internet and the Electronic Commerce by advanced technology of the information & communication has caused the transition of the financial settlement system all over the world. The Electronic Commerce has become one of the most important tools to decide value ranging from the real money, existing bills and coins to the Electronic Money. The Electronic Money will be a very useful material at cyber times in the future. This encouraged me to study the Electronic Money’s modern definition and to analysis the common use situation, operation at home and abroad at Electronic Commerce times. In add to investigated advanced countries Electronic Money utilization and drawed out current events point. Furthermore to discuss the legal problems occurring in the process of using the Electronic Money and to study legal definition of the Electronic Money in Korea. It’s hard to say that the Electronic Money is being used extensively in Korea and how the Electronic Money is issued. Therefore, this paper is a just try to understand the legal problems of the Electronic Money and it is necessary to study more on this matter. So. I suggested legal measures on the Electronic Money can be considered in two ways. One way is to make a special law of the transfer of the Electronic Money or to regulate new rules to protect consumers. The other way is to apply to the existing legal system and to revise the Banking Law or related stipulations.
