교정복지정책의 결정과정에 있어서 정책갈등에 관한 연구

A Study On the Policy Conflict in the Decision -Making Process of Correctional Welfare Policy - A Case Study of Private Prisons -

본 연구는 정책결정 당시 국회회의록 상 법무부의 민영교도소 제도 도입의 취지와 이에 대한 전문위원 검토, 그리고 국회의원 질의를 중심으로 한 내용분석을 통하여 갈등쟁점을 도출하고자 하였다. 이와 연계하여 집행과정에서 나타난 언론 보도에서 민영교도소 추진과정 상의 갈등쟁점이 어떻게 부각되었는지를 비교 검토하였다. 본 연구의 사례인 민영교도소 설치·운영에 대해 순수공공재의 민간이양에 대한 국가의 본례의 기능 논란이 심각하게 고려된 점과 주민저항에 대해 정책적 대응이 전혀 마련되어 있지 않았음을 확인할 수가 있었다. 연구의 결과를 바탕으로 해당 정책이 성공과 실패하였을 경우 근본적 원인을 규명하고 적절한 정책대안을 만들어 내는데 도움을 줄 수 있도록 정책집행의 실효성을 담보할 수 있는 경험적 자료를 제시하고자 한다.
