헌법상 공무원의 정치적 자유의 제한과 그 한계

The Regulation and Limits of Official’s Political Freedom in Constitutional Law

공무원의 정치활동은 헌법 제7조 제2항에서 공무원의 정치적 중립성과 직업공무원제도의 구체화를 법률로 정하도록 한다. 그러나 공무원의 정치활동의 허용 및 금지에 관한 명확한 법령의 규정이 없어서 법원이나 헌법재판소가 재판의 어려움을 경험하고 있다. 한편, 영미와 독일 및 프랑스는 현대 정당민주국가 하에서 공무원이나 교원들에게 정치적 중립성을 인정하지만 기본적으로 정치활동의 자유를 넓게 보장하고 있다. 공무원의 정치활동이 직무와 관계없으면 자신의 정치적 자유를 향유하고, 반면에 일본은 미국의 1939년 ‘Hatch Act'의 영향을 받아서 공무원의 정치활동의 자유를 열거적인 허용요건에 의하여 명확하게 규정되어 있다. 요컨대, 공무원의 정치적 자유는 그의 특성에 따라서 다음과 같이 네 가지로 구별된다.1) 첫째, 정치적 의사 표현의 자유롭게 향유하고(정신적 자유의 개인적 측면). 둘째, 정당의 가입과 활동에 의해서 정당정책에 반영하는 자유(정당참여의 사회적 측면). 셋째, 공직선거에서의 입후보나 후보자를 지지하는 등 적극적인 참정권 행사(선거참여의 공적 측면) 넷째, 공무원이 직접 직무의 형식 및 내용과의 관련성 여부에 따라 정치적 활동의 범위가 결정될 수 있다.

There has been continued criticism that officials’ political actions have been judged from violation by the Constitutional Law Clause 7 and National Official Act and Local Official Acts so far. As there has never been any definite provisions that officials’ political action shall be allowed or prohibited, Courts and Constitutional court have been in trouble for their litigations. Under the Partisan Democratic State, UK and USA and Germany and France have allowed the political neutrality to parties, but they have assured their freedom of political actions in public and in broad. If officials’ political action has not related with their job and its function such as time and place etc, they can enjoyed their freedom in fundamental. But Japan was effected by ‘Hatch Act’ of 1939 from United States of America in 1950s, and his officials’ political freedom shall be allowed in definite by an enumerated permission provision. In final, officials’ political freedom can be classified in four types by their characters of freedom as following: the individual level of mental freedom, and social level of partisan participation, public level of vote participation, and officials’ impartiality toward his/her job and function such as time and place.
