A Study on the Online Dispute Resolution(ODR) System for Electronic Commerce Dispute Settlement

Electronic commerce constitutes an important part of all commercial activity. Considering the feature of electronic commerce, traditional dispute resolution system such as lawsuits in the court does not proper method to resolve the conflicts from the online transactions and electronic commerce because of cost, time, law, etc. Those problems have resulted in the rapid evolution of Alternative Dispute Resolution(ADR) and the advent of Online Dispute Resolution(ODR) as new resolutions methods for online disputes because of convenience, sweetness, low cost, etc. As of now, ODR appears to be the best way for resolving electronic commerce disputes. Korea Consumer Agency(KCA) and Korean Commercial Arbitration Board(KCAB) and especially E-Commerce Mediation Committee(ECNMC) attempt to offer new way of disputes resolving system such as online chatting mediation service and desktop video-conferencing mediation service. However, due to weak technical, lawful environments, this ODR system is still new on the path of development. Therefore purpose of this paper is to review the types of ODR, as the dispute settlement way in electronic commerce. This study point out the task that Korea has to promote the ODR for more effective and efficient dispute settlement.
