교정시설내의 보안경비체제의 발전방향

The development direction of prison security system

교정시설 등에서의 보안체제의 형성 메카니즘은 주로 수용자들에 대한 계호행위와 징벌로 구성된다. 이러한 보안재(保安財)의 생산은 국가관료독점체제하의 획일적인 생산방식인 경로의존적인 방식으로 지금까지 행해져왔다. 이중에서 계호행위는 사전적 또는 사후적인 보안재의 생산개념이라 할 수 있고, 징벌론은 이미 교정사고를 일으킨 수용자들에 대한 사후적 보안재의 생산 이라고 할 수가 있다. 일반적으로 계호의 개념은 행형이나 교정의 이념이 무엇인가에 따라 역사적으로 달라져 왔다. 하지만 현대의 교육행형주의에서는 계호란질서유지와 같은 보안재의 생산 외에도 수용자에 대한 보호재(保護財)의 생산도 내포하게 된다. 이러한 계호행위는 대인적 계호와 대물적계호 및 대물적 계호행위로 나뉘며 대인적 계호행위에는 보안장비나 무기의 사용 등이 있고 대물적 계호행위에는 금지와 물품검사 등이 있다 그리고 혼합적 계호체제에는 영상정보 처리기기 등이 있다. 그리고 교정사고를 일으킨 수용자들에게 내리는 징벌에는 경고와 금치 등 14개의 종류가 있는데 징벌은 소장의 징벌요구가 있게 되면 징벌위원회의 의결을 거쳐 징벌의 종류가 결정되고 소장이 이를 집행하게 된다. 그러나 우리나라의 교정시설의 보안체제에는 다양한 문제점들이 경로 의존적인 생산방식으로 수확 체증적으로 계속되고 있어 질 좋은 교정 보안재의 생산성을 저해하고 있으므로 경로혁신적 관점에서 새롭게 개편해야 한다. 따라서 보안체제의 발전방향은 국가 관료독점 생산체제에서 벗어나 민간경비 등과의 제3섹터적 생산을 통하여 보안재의 독점생산으로 인한 폐해를 방지하고, 아울러 비과학적이고 비전문적인 교정 보안체제에서 탈피하여 보다 전문적인 보안체제의 확립을 위하여 경비학 등 전문지식을 가진 자들을 보안교도관으로 임용하여 시험의 타당도를 제고해야 한다. 그래서 통합적 보안 패러다임의 확보가 시급하므로 다음과 같은 대안을 제시한다. 첫째, 기존의 능률성 중심의 보안 패러다임에서 벗어나 민주성과 생산성, 사회적 형평성과 회복적 사법이념이 가미되는 보안 패러다임의 확립이 있어야 한다. 둘째, 법적 측면에 치중된 보안개념을 심리학과 사회복지학 및 경제학 등의 학제적 개념으로 확대 통합해야 하는바 그것은 교정보안재의 실질적 생산성을 제고할 수 있기 때문이다.

In this article, I would like to explore a little further the proper development direction of the prison security system which has been composed of guard againist the danger by prisoners and punishment toward prisoners who violate the established rules in the prison. these prodction of security public service in the prison has been carried out through the way of standardization by national bureaucractic monopoly regime. Prison security system has guard against the prison accident and punishment toward prisoners violating the established rule and laws about correction. But korean prison security system has diverse problems in view of the path-dependence security regime which has dominated korean prison public order during the last several decade. Therefore, I would like to show to the problem which has been involved in the prison security regime and to discuss the existing prison security theory against my insistence in detail and to propose the new development direction of the korean prison security public service production in the view of the path-breaking theory in the prison security regime. the path-breaking security public production in the prison has the third-sector in relation to the civil security and the integrated paradigm of the prison security system. I chose this theme, not only because it is the only security paradigm but also because it can have the diverse and integrated paradigm in the prison security public service production. Therefore, it seems reasonable to conclude that the concept of the prison security regime shoud have integrated paradigm.
