경찰의 정신지체장애 성범죄 피해자 보호방안에 관한 연구

A Study on the Countermeasure of Police for Sexual Crime Victims against Mentally Handicapped

경찰에서는 성폭력 범죄피해자 보호를 위한 각종 수사지침을 만들고 전문인력을 채용하는 등 많은 노력을 하였다. 하지만, 아직까지도 문제점들이 제기되고 있다. 특히, 최근에 광주 인화학교 장애인을 상대로한 성폭력 사건이 영화화 되면서 장애인에 대한 성범죄가 사회적 이슈로 부각되었다. 정신지체장애인들은 성폭력 범죄 피해를 입고서도 수사절차상 신문과정에서 성폭력피해자에 대한 잘못된 통념으로 인해 오히려 비난을 받거나 심리적 손상을 받는 등 불이익은 물론, 피해상황을 일관되고 정확하게 진술하지 못하여 큰 어려움을 겪는 경우가 자주 발생하고 있으며, 경찰, 검찰수사, 법원에서의 진술과정동안 장애인 피해자를 위한 배려와 장애인에 관한 기본적인 이해를 잘 이루어지지 않고 있다. 그러나 여전히 상당수의 정신지체장애인들은 자신의 성적 권리가 유린되어진 상황이 발생해도 자신들이 가진 장애의 특성으로 자기권리 주장을 내세우지 못한 상태에서 성범죄의 1차 피해를 경험하게 되고, 경찰 등 형사사법기관의 잘못된 인식으로 2차 피해를 경험하는 경우가 많다. 특히 정신지체장애인들은 성범죄 피해에 대처할 저항능력이 부족하고, 지적능력의 저하로 성범죄 조사 과정에서 일관된 진술을 못하는 경우가 자주 발생한다. 따라서 이 논문에서는 그 동안 사회의 관심 대상 속에 있지 못함으로 인해 많은 피해를 받은 정신지체장애인에 대한 성폭력 사건의 심각성을 재조명하여 사회적 약자의 이들의 입장에서 이들을 위한 효과적인 형사법적 대응방안을 검토·제시하였다.

Recently, it is focused on a matter which is related to people right of the victims as like support of victim or the secondary victimization. The police is one of the criminal justice system to investigate crime and has been taken charges of investigation, arrest and other things. But as a matter about victims in criminal justice system grew more bring out, the movement which must be investigated and dealt with the incident in the victim's position has grown serious. Accordingly, the police is being requested to have system which can investigate crime accident by taking report to civilians and prevent recurrence of victim and keep a relationship with victims through activity to protect them. That is, the victims in the police is just not a witness for investigation but a collaborator, for bringing crime to their attention and providing leads on the offender, and moreover for bringing up a protective abilities by themselves. Of the crime victims, especially sexual assault victims, although they were given an unfair encroachment, they endure prejudice and blame of social. Owing to these situation, most of sexual assault victims don't reveal the truth honorably and be distressed. Therefore, it is a serious problem to provide various social support service and connection with support system for sexual assault victims. Namely, to live sexual assault victims safetly, overcoming crisis situation and being protect, it must be back up support of sexual assault crisis hot line, consultation center, temporary protective center, police, law organization, medical institution, an organ of public opinion, and other things.
