IncotermsⓇ 2010 Rules entered into force on January 1, 2001. the new 2010 edition of the rules is the first version of the rules reflecting the Institute Cargo Clauses revised by the LMA/IUA in 2009. The IncotermsⓇ 2010 rules deal with contract of insurance and clarify the seller's and buyer's obligations to provide information relating to insurance in articles A3 b)/B3 b). These provisions have been moved from articles A10/B10 of the Incoterms 2000. Moreover, the IncotermsⓇ 2010 rules provide that under articles A3 b) and B3 b) of CIF and CIP rules, the seller must obtain cargo insurance cover complying with at least the minimum cover provided by Institute Cargo Clauses (C) or any similar clauses. When required by the buyer, the seller must also procure addition cover such as cover provided by Institute Cargo Clauses (A) or (B); or Institute War clauses or Strike Clauses. This is at the buyer's risk and expense if procurable. The purpose of this paper is, therefore, to analyze the clauses of contracts of insurance under articles A3 b) and B3 b) of IncotermsⓇ 2010 Rules and to provide the problems of the clauses.
