STCW협약의 전면 개정을 위한 기본원칙 고찰

A Study on the Principles for Comprehensive Review of the STCW Convention and Its Code

IMO STW전문위원회에서는 제38차 회의부터 STCW협약 및 코드의 개정을 위한 전면적인 검토를 수행하고 있다. 또한 STW 전문위원회는 이 검토작업을 위해 다음의 8가지 기본원칙을 정하였다. ①1995년 개정 STCW협약의 구조 및 목표를 유지할 것, ②현행 협약기준의 수준을 낮추지 말 것, ③협약의 본문은 개정하지 말 것, ④이미 나타난 불일치, 해석, MSC의 지시사항 및 명백히 밝혀진 사항과 사문화된 규정 그리고 과학기술의 발전 등을 고려할 것, ⑤효과적인 정보전달을 위한 제반요건을 고려할 것, ⑥기술혁신으로 인한 해기능력 조건의 유연성과 교육훈련, 자격증명 및 당직근무의 요구수준을 마련할 것, ⑦단기 해상운송업 및 해상산업의 특수한 특성 및 환경을 고려할 것, ⑧보안관련 사안을 고려할 것이 논문은 이 기본원칙에 따라 향후 STCW협약의 개정이 예상되는 주요 내용을 알아보고, 국내에 미칠 영향을 제공하고자 한다.

IMO STW Sub-committee is carrying out the comprehensive review of the STCW Convention and its Code for amending them. The Sub-committee agreed that the review should only embrace the following principles: ① retain the structure and goals of the 1995 revision, ② not to down scale existing standards, ③ not to amend the articles of the Convention, ④ address inconsistencies, interpretations. MSC instructions, clarifications already issued, outdated requirements and technological advances, ⑤ address requirements for effective communication, ⑥ provide for flexibility in terms of compliance and for required levels of training and certification and watchkeeping arrangements due to innovation in technology, ⑦ address the special character and circumstances of short sea shipping and the offshore industry, and ⑧ address security-related issues. This study aims to introduce the significance matters of STCW Convention and its Code which is to be expected to amend in accordance with the above principles and to provide an influence to the shipping industries and Government.
