국제재판사례 분석을 통한 대마도 영토권 회복방안 연구

A Study on The Retrocession of Tsushima's Territorial Sovereignty through the Analysis of International Tribunal Case

국가간의 영토분쟁은 심각한 갈등을 초래하게 된다. 영토분쟁에서 가장 중요한 조건은 효과적 소유의 원칙이다. 법원은 분쟁된 지역에서 평화롭고 실제적이며 지속적인 효과적 소유를 필요로 한다. 효과적인 소유는 역사적 기록 및 정부간 문서를 기반으로 한다. 본 논문의 목적은 대마도 영토주권의 반환에 대한 방안의 제시이다. 국제정세의 분석을 통해 대마도를 일본의 영토로 복속하는 것에 조선정부가 저항을 하지 못한 이유를 분석해 본다. 또한 영토주권에 관한 최근 국제재판 사례를 분석한다. 이를 통하여 우리의 영토인 대마도의 반환방법을 제시한다.

Territorial disputes between nations, causing serious conflicts. The most significant criterion in territorial disputes is the principle of effective possession. The courts required that the effective possession of the disputed areas should be peaceful, actual and continuous. The evidence of effective possession can be found in historical archives and intergovernmental documents. The purpose of this paper is to the solution for retrocession of Tsushima's territorial sovereignty. Analyzes the background that why Chosun Government didn't resist the Japanese abrupt incorporation of Tsushima into Japanese territory through the international situation. Also analysis of International Tribunal Case of concerning sovereignty lately. and show the way of retrocession of our land territorial sovereignty of Tsushima.
