A study on the improvement upon the laws violating child and youth labor right

본 연구는 아동·청소년의 ‘일할 권리’를 제대로 실현하지 못하고, ‘보호받을 권리’를 제대로 보장하지 못하는 관계 법령의 문제점을 파악하여 개선방향을 제시하는 것을 목적으로 하였다. 독일·프랑스·일본의 관계법령, 그리고 국제노동기구(ILO)의 협약, 유엔아동권리협약을 참고하여 근로기준법과 최저임금법에 관련된 취업의 최저연령, 노동보호의 최고연령, 연령의 증명과 친권자의 동의, 근로계약, 근로시간, 야업 및 휴일근로, 최저임금, 근로감독에 관한 내용을 다루었다.

The purpose of this study is to propose the direction of reform on related laws, pointing out the problems of these which do not realize child and youth’s right to work and do not secure their right to protect from working. This study includes the minimum age of working, the maximum age of protection from working and so on related with the Labor Standard Act and the Minimum Wage Act, referring to the laws of Germany, France, and Japan, ILO conventions, International Convention on the Right of the Child.
