자치경찰제 도입을 위한 주요쟁점분석과 시사점

A Study on the Issue for the Introduction of the Municipal Police System: With a Case of Jeju Municipal Police System

치경찰은 지방자치의 핵심적인 요소로써 민주적 및 분권적인 경찰활동을 가능하게 하며 주민참여를 통하여 서비스의 질을 확보할 수 있다는 점에서 그 의의를 찾을 수 있다. 이에 따라 지난 2008년「지방분권촉진에 관한 특별법」에 지방행정과 치안행정의 연계성을 확보하고 지역특성에 적합한 치안서비스를 제공하기 위하여 자치경찰제도의 도입을 규정함으로써 자치경찰제 도입을 위한 법적 근거를 마련하였다. 그러나 자치경찰제 실시를 위해서 전제되어야 할 여러 쟁점들에 대한 합의에는 아직 이르지 못하고 있다. 이에 본 논문에서는 제주자치경찰의 경험을 토대로 우리나라 자치경찰제 도입을 위한 주요 쟁점 중에서 특히 설치단위, 사무, 수사권, 재정 부담을 중심으로 분석해보았다. 이러한 쟁점사안들은 자치경찰 도입의 목적에 부합하면서도 우리 실정에 적합한 자치경찰제 실시를 위하여 자치경찰 모델은 어떻게 정립하여야 하는가와 직결되는 문제로서, 제주자치경찰제를 시행하면서 특히 논란이 되고 있는 사안들이다. 이에 따라 제주자치경찰사례를 중심으로 전문가 질적 조사를 실시한 결과 자치경찰제의 활성화를 위해서는 첫째, 자치경찰사무의 명확한 배분과 고유 업무 확보 둘째, 자치경찰의 수사권 등 권한의 확대 그리고 마지막으로 안정적인 재원확보방안 마련이 전제되어야 할 것으로 보인다.

The Municipal Police System can facilitate democratic and decentralized police activities as a key element of the local government. Its significance can be found to obtain the quality of services through citizen participation. Accordingly, the legal basis for the introduction of the municipal police system was established by ensuring linkages of local administration and policing administration in the ｢Special Act on decentralization advancement｣, and regulating the introduction of the municipal police system to provide appropriate policing services to local characteristics. However, in order to conduct a municipal police system, challenges on handling the issues, such as introduction unit, secretary allocation, securing an investigation, and financial burden, are still being debated. This paper discusses these key issues based on Jeju municipal policy system's cases. Based on the qualitative assessment on Jeju municipal police system, we find the implications for the implementation of the municipal police system. First, it is necessary to specialize in the peculiar business and functions of the municipal police system. Second, the authority of the municipal police system should be expanded. Third, a plan for stable funding should be drawn up.
