장애인차별금지법 제정 과정의 담론의 동학

Dynamics of Policy Discourse in Legislative Process of Disability Discrimination Acts - Policy Change and Discourse in Discursive Institutionalist Perspective -

본 연구는 차별금지법 입법과정의 정책담론을 분석하여 정책변화이론과 연결시키려는 시도이다. 담론제도주의의 시각에서 미국과 우리나라의 사례를 비교하여 장애인차별금지법 제정 과정의 담론의 동학이 분석되었다. 미장애인법 제정 과정에서는 장애옹호가들의 기회평등담론과 정부의 활성화담론이 미국장애정치의 민권적 유산 아래 맞물려져 나타났다. 그러나 정책행위자들의 상호작용을 이끌어 타협점을 찾는 기능을 수행한 것은 활성화담론이었다. 반면 장애인차별금지법에서는 활성화담론의 위축과 기회평등담론의 변이가 발생하였다. 기회평등담론은 보다 광범위하고 보편적인 적용력을 가지고 있으며 한국장애인들의 현실에 정합적인 인권담론으로 수정된후 장애계 내부의 응집력을 높이는 역할을 수행하였다. 주어진 사회정치적 배경 속에서 담론들은 정책변화를 주도하기도 하고, 기존의 정책지형으로부터 구속을 받아 변형되기도 하였다. 담론의 동학은 장애정책변화의 메카니즘을 설명하는데 유용하게 활용될 수 있음이 확인되었다.

This study seeks to show that analysis of policy discourses can be linked to theory of policy change. Two cases of legislative process of disability discrimination act were compared, focusing their dynamism of policy discourse, on theoretical basis of discursive institutionalism. In Americans with Disabilities Act, equal opportunity discourse of disability advocates and activation discourse of government was combined under the legacy of civil rights of disability politics. But the latter discourse facilitated interactions and negotiations between actors. Meanwhile, in Prohibition of Discrimination against people with Disabilities Act, disabled representatives took the leading role in the whole process, shrinking of activation discourse and alteration of equal opportunity discourse occurred. Equal opportunity discourse was replaced by human rights discourse which had broader and universal implications and fitted to real world of disabled persons. It contributed to fasten internal cohesiveness of disabled groups. Policy discourses, demonstrating their varieties and dynamics, can initiate policy change, simultaneously, be framed and constrained by policy configuration.
