전자상거래 분쟁해결제도의 활성화 방안에 관한 연구

Study on the Settlement Disputes of Electronic Commerce -With Emphasis on the ADR System-

정보통신기술발전과 인터넷의 출현으로 전자상거래의 규모가 포괄적으로 증가하고 있다. 이에 따라 발생되는 분쟁을 해결하는 다양한 제도 중 ADR 분쟁해결제도가 등장하여 분쟁을 어느 정도 효율적으로 해결하고 있다. 따라서 본 연구에서는 전자상거래의 ADR을 중점적으로 검토함에 있어서 먼저, 국제거래에서 발생한 분쟁들을 합리적으로 해결하는 기본원칙과 전자상거래 분쟁유형 등을 살펴보고, 이어, ADR 분쟁해결제도에 관하여 기본운용원칙, 운용메커니즘, 운용 사례 등을 중점적으로 분석·검토하고 결론에서는 전자상거래 분쟁을 미연에 예방함과 분쟁을 합리적이고 효율적으로 해결하기 위한 대응과제 등을 제시하여 전자상거래의 발전을 모색하고자 한다.

The scale of electronic commerce has been getting bigger with the development of information technology and emergence of internet around the world. Because of that, ADR relating to electronic commerce has been increased with growing amount of disputes. Therefore, this paper looks through ADR by analyzing cases of dispute, the basic principle of resolving method of disputes. Together with this, the management principle, mechanism, cases of ADR have been examined to suggest ways solving problems and to find out plans to prevent disputes relating to electronic commerce.
