A Study on the Risk Management of High Science and Technology

The innovation of science and technology not only improves the quality of life in peoples of nation through the growth of national economy, but also contributes greatly the development of culture and promotion of welfare in mankind. But, it inevitably brings about dangerousness and dysfunction on our society, too. In research and development and the use of its outcome of high science and technology, IT, BT, NT, etc, the dangerousness and damages will be occurred to life, body and environment, due to the dangerous materials or risky function and characteristics of new products. As a result, it is very necessary to consider the legal system that control the dangerousness/risk of science and technology systematically. This paper aims to study on the theory and methodology of risk management derived from high science and technology. Especially, it is layed emphasis to search for the realizing structure of risk management in science and technology based on the foundation and contents of substantive law and regulation. For this purpose, the changes and characteristics of risk followed by science and technology development will be surveyed, the scheme and system of risk coming out from science and technology development will be analyzed, the legal foundation and concrete control way and method of risk management will be investigated, and finally, the judicial control on the risk of science and technology will be researched.
