법과 쾌락의 문제에 대하여

Law and Pleasure

현대에 들어서 철학자들에 의해 계속 제기되고 있는 문제들 중 하나는 바로 몸과 맘 사이의 관계와 연관이 있다. 그리고 이러한 문제제기에 있어서 흔히들 몸과 맘은 이원론적 혹은 일원론적 관점에서 파악될 수 있다는 하나의 입장을 취하는 것에 만족하고는 한다. 하지만 몸과 맘의 문제는 어쩌면 추상적인 의미에서, 다시 말해 이론적인 의미에서 인식하고자 하는 우리들의 시도에서부터 나오는 것일지도 모른다. 본 논문에서는 이러한 몸과 맘의 문제를 추상적으로 다루는 것에서부터 벗어나, 칸트의 도덕철학적 기획의 실천적 영역인 근대적인 법 체계와 그 법이 인간의 욕망을 바라보는 관점을 파악한후, 그러한 법 체계가 이전의 시대, 즉 소크라테스와 플라톤과 같은 고대의 법과 지니는 차이점이 무엇인지를 살펴보고, 그러한 근대적인 법 체계 안에서 법의 원리들이 전복되는 두 가지 원리인 유머와 아이러니의 상황을 통해 인간의 쾌락 혹은 욕망이 합리적인 방식으로 근대법의 근본적인 원리를 부정하고 극복하고 있음을 살펴보고자 했다. 그리고 이러한 고찰로부터 쾌락이란 그 본질상 육체적인 것만도 정신적인 것만도 아니며, 오히려 이 둘 사이의 변증법적 종합이라는 자그마한 동시에 소중한 결론을 지을 수 있기를 바랐다.

Nowadays there is an important problem that is proposed by contemporary philosophers, the relationship of mind and body. And Almost, I think, they have satisfied that they just can take the viewpoint which of dualism or monism. But this habit of thinking like this, I think, maybe have become from our metaphisical or theoretical trying to know the relationship of mind and body. In this paper, I tried to be far from the habit like this and to understand the modern law-system, the practical part of the moral philosophical plan of Kant and the point of view of it about human desire. And I tried to show the difference between that and the andcient law-system in Socrates and Platon. Finally, from Sade and Masoch, we know the negation of and the overcome from the modern law-system by the reasonal and rational two way, humor and irony that is operated by human's pleasure and desire. From this study, we know that the pleasure is not just bodily or mental, but the dialectic syntheses between mind and body.
