랑시에르의 정치론에 의거한 한국 학생인권조례 연구

A Study on ‘the Ordinances of Human Rights for Korean Students’ upon Ranciéres Political Theory

최근 한국에서의 학생인권 조례의 제정과 시행과 관련한 갈등은 상급 교육권력기관인 교육과학기술부와 하급 교육권력기관인 시도 교육청 간의 대결 양상까지 보이고 있다. 이에 이 글에서는 랑시에르의 정치이론을 사용하여 한국의 학생인권조례의 본질을 분석하고자 하였다. 랑시에르에 있어서 정치란 해방의 논리에 입각하여, 기존의 감성분할 다시 말해 기존의 사회구조에서는 배제되어 보이지 않던 자가 모습을 드러내어 자기 몫을 주장하여 챙기는 일이고, 치안은 침잠의 논리에 입각하여 기존의 감성분할 상태를 유지함으로써 모습과 몫이 배제된 자들이 계속하여 배제되게 하는 일이다. 랑시에르의 정치이론에 의거해 볼 때, 학생으로 하여금 인간으로서 권리를 갖게 하려는 학생인권조례를 제정·시행하는 일은 정치 차원의 일이다. 이에 비해 학생인권조례 시행을 부정하고 이를 무력화 하려는 시도는 학생에게 있어서 인권의 몫을 인정하지 않는 기존의 사회 틀을 유지하려는 치안 차원의 일이다.

The purpose of this study is to analyze the Ordinances of Human Rights for Korean Students on the political basis. The theory which used for the analysis is Ranciére’s political theory. Recently the Ordinances of Human Rights for Korean Students have been being arguely enacted by the Metropolitan City and Providence Education Offices in Korea, and The Ordinances are working. However, the conservatives and Central Government officers have been being against up actions of the Education Offices on the Ordinances. So Korean education society is going to face predicaments. In the Ranciére, ‘politic’ are not jobs which involved with political power and political institutions. It is that the one who be excluded come to get his/her appearance, takes his/her place at an inside of community and come to gains his/her place through re-partition of perceptions. In the other words, the politics is on the logic of the ‘emancipation’. And ‘police’ are not businesses which involved with police officers. It is that the one who has no appearance is stuck in his/her existing status, the one who dose not have his/her place is boxed in the existing status under old partition of perceptions. In the other words, the police is on the logics of ‘saturation’. For the Ranciére’s politic and police theory, the enacting of the Ordinances of Human Rights for Students’ is equal to the politic. The acting is what let Korean students be made visible, and take him/her place. In the contrary, the actions against the Ordinances are equivalent to the police. The against action is what let Korean students be stuck in no appearance, and do not let them take him/her place.
