경찰관직무집행법의 개정방안에 관한 연구

A Study on the Proposals for Revision of Act on the Performance of Duties by Police Officers

오늘날 고도의 위험사회 속에서 살고 있는 우리들에게 위험방지를 위한 경찰권 행사의 필요성과 중요성은 과거에 비해 더욱더 높아지고 있다. 하지만 경찰권행사는 개인의 기본권을 보장하면서 다른 한편으로는 기본권을 침해할 우려를 동시에 내포하고 있으므로 공공의 안녕과 질서유지를 위한 경찰권행사는 반드시 법률의 근거 하에 행사되어야 한다. 이러한 경찰작용법상 법적 근거의 중심이 바로 경찰권행사의 일반법적 성격을 가지고 있는 경찰관직 무집행법이다. 그러나 현행 경찰관직무집행법은 다른 법률에 특별한 규정이 없는 한 모든 경찰작용에 적용되는 일반법으로서의 지위를 가진다고 보기에는 여러 문제점을 안고 있음을 부인하기 어렵다. 무엇보다도 실질적 의미의 경찰개념의 본질적 요소를 이루고 있는 일반적 수권조항과 경찰책임에 대한 경찰관직무집행법상 근거규정의 결여, 경찰상 일반적 강제수단의 부재 등은 현행 경찰관직무집행법이 경찰권행사에 있어 일반법적 기능을 하기에는 많이 미흡하다. 따라서 이와 같은 문제점들을 중심으로 현행 경찰관직무집행법의 내용을 정비하여 경찰작용의 일반법으로서의 기능을 보다 명확히 해야 한다.

Recently, the necessity and importance of exercise the police authority for prevention of danger are getting higher to us who living in risk society. But the exercise the police authority involves not only the guarantee people's basic human rights but also violate the people's basic fundamental human rights. So it must be exercised by legal. Like this the core of legal basis on the law of police action is the ‘Act on the performance Duties by Police Officers’ which has character the general law. Above all things, the risk of authorized article which forms the essentials and applicable provisions of 'Act on the performance Duties by Police Officers' about responsibility of the police, and the absence of method about compulsion of the police, etc. are still insufficient to do the function of general law. So with these problems as the center, maintain the contents of the ‘Act on the performance Duties by Police Officers’ and make clarify its function as the general law.
