해운ㆍ항만 분야의 규제 품질 개선 방향에 대한 연구

Study on the Regulatory System of the Shipping and Port Industry

본 연구는 우리나라 해운ㆍ항만 분야에 등록된 314개의 규제를 대상으로 보다 바람직한 규제체계의 방향을 설정하는 것이 목적이다. 이를 위해 이 연구에서는 현재 우리나라 해운ㆍ항만분야의 규제 수준이 OECD가 규정한 규제 3단계 가운데 초기수준인 규제 1단계에 있음을 지적하고, 규제의 복잡성 등 OECD(1993)가 제시한 8개 규제순응 저하요인을 적용한 2단계 조사기준에 따라 우선순위를 선정하였다. 이 결과에 따르면 314개의 등록규제 가운데 규제순응도 조사가 필요한 규제는 28개 규제였으며, 완화 또는 폐지해야 할 규제는 9개, 새로운 규제체계로 바뀌어야 할 규제는 5개인 것으로 밝혀졌다.

The purpose of this paper is to suggest the desirable regulatory system to the Shipping adn Port division. This paper indicates that the regulatory system of Shipping, Port, and Logistics division in Korea is in the first step and there need to introduce new regulatory quality management system such as Regulatory Impact Analysis(RIA). This paper makes new collection criteria based on OECD(1993) standard, and applies to 314 regulations to collect the regulations that need regulatory compliance tests. As a result, we choose 28 regulations that need regulation compliance test. 9 regulations that need to be deregulated, and 5 regulations that need to introduce new regulatory system.
