선거사범에 대한 경찰의 역할에 관한 연구

A Study on the Aggressive Police Countermeasure for Election Crimes Participation Event

헌법 제1조에서 대한민국은 민주공화국이며 대한민국의 주권은 국민에게 있고, 모든 권력은 국민으로부터 나온다고 천명하고 있다. 그러므로 우리나라의 국가작용은 국민의 의사에 따라 행해져야 하지만 모든 국민이 직접 국가작용에 참여는 어려운 실정이다. 그러므로 이러한 민주적 정당성을 확보하기 위해 국민이 직접 선정하는 대표자를 선출하여 국정을 운용하는 대표민주제를 원칙으로 하고 있다. 즉, 선거제도의 운용에 따라 민주주의의 성패가 직결된다고 할 수 있다는 의미이다. 따라서 선거와 관련되는 부정을 방지함으로써 민주정치의 발전에 기여함을 목적으로 하는 공직선거법이 있으며, 공정한 선거관리를 위해 선거관리위원회를 중심으로 검찰, 경찰 등의 국가기관에서는 투, 개표 사무 등 법정 선거사무의 공정한 관리와 선거운동 과정에서 적법성과 공정성을 확보할 것을 규정하고 있다. 하지만 선거관리위원회의 경우 수사지휘권이 있는 검찰에게 대부분 수사의뢰를 하고 있으며, 일부 사건을 제외한 대부분의 사건은 경찰로 이첩하여, 이러한 과정에서 소요되는 시간 등의 문제로 인해 수사지연 및 증거인멸 등 수사에 어려움을 나타내고 있다. 일선에서 활동하는 경찰은 선거사범의 특징이나 대내ㆍ외적인 이유로 수사의 어려움을 겪어 소극적인 대응을 하고 있으므로 선거사범에 대한 경찰의 적극적인 개입을 통해 바람직한 선거문화를 이루고 민주주의 제도를 정착화 할 수 있는 방안을 모색해 보도록 한다.

The success or fail of democracy is all depend on how manage or operate the election system. Depend on how people as voter, exercise their right to vote, election system might be becoming a tool of realizing true democracy or tool of rationalizing dictatorship or plutocracy. The police, prosecution and national election commission exist for secure the freedom and fairness of the election and they observe and crack down any illegal activities during the election. The national election commission request or report any illegal activities to police and prosecution, then the prosecution arrange the requested case or transfers most of case to police. Also the prosecution receives some cases from police and takes a response of institution and support of a public action it. As mentioned, the roles of these three organizations are quite different, but they are closely connected each other. As mentioned above, the election system is very important and because of significance the election system, crack down and sanction against election irregularities are very significant. However, the police take passive action on election irregularities because of its specialties or public and internal reason. There are several difficulties which make police take passive action on election irregularities. Therefore, three possible effective counterplans can be suggested. Firstly, reinforce the training system of police officer. Secondly suggestion is utilizing of election illegal activity observer. Finally build cooperate system with interagency to crack down the online election irregularities is suggested.
