기술유출범죄의 실태분석 및 대응방안에 관한 연구

A Study on Counter-Measures on the Technology Leakage Crimes an Their Enhancement

우리나라에서 매년 증가하고 있는 기술유출범죄에 의한 피해는 막대한 국가적 피해를 초래하고 있다. 이 연구에서는 기술유출범죄에 대하여 이론적으로 고찰해 보고 우리나라의 기술유출범죄의 실태와 문제점을 분석하여 기술유출범죄에 효과적으로 대응하기 위한 방안들에 대하여 살펴보았다. 기술유출범죄에 대하여 효과적으로 대응하기 위한 방안들을 간략히 정리해보면 다음과 같다. 첫째, 기술유출범죄에 대한 법ㆍ제도적 장치의 마련이다. 둘째, 산업보안에 대한 인식의 제고이다. 기술유출범죄 문제는 더 이상 기업만의 문제가 아닌 국가차원의 문제이기 때문에 전반적인 사회적 인식의 전환이 필요하다. 셋째, 보안관리 감독체계의 구축을 들 수 있다. 기술유출범죄로 인하여 산업기밀이 유출되고 나면 범인을 체포하더라도 이미 유출된 산업기밀로 인하여 기업의 피해는 막대하기 때문에 기술유출범죄는 사후대응보다 사전에 예방하는 것이 가장 기술유출범죄에 효과적으로 대응하는 것이다. 따라서 보안관리의 감독체계의 구축은 무엇보다도 중요하다.

The Technology Leakage Crimes issue is not just limited on company competitiveness, but the country competitiveness depends on it too. As the number of Technology Leakage Crimes cases is increasing year by year, a damage to the country’s industries rises accordingly. In this paper, we will analyse a case study of an actual Technology Leakage Crimes and problems, then search for countermeasures on the issue. Here I recap them briefly. First, law and institutional devices for Technology Leakage Crimes are demanded. Since we have loop holes in the law for Technology Leakage Crimes, we made law. But it is not enough and keep working on law revision. However, so far not much law revisions are being improved. Second, a recognition for industrial security should be raised. Since the problem is not only belong to company level but county, overall turnover of society recognition is needed. The third one is a construction of security administration & supervision. It is no use to capture the spy, after the industrial espionage outflows. So prevention is more effective than after the fact countermove. Therefore, the government, companies and citizen all should cooperate for the construction of security administration & supervision.
