민간조사업체의 증가 원인과 문제점

The Cause of an Increasing Number of Private Investigator Agencies and the Subsequent Issues

이 연구에서는 2011년 9월부터 12월까지 서울지방경찰청과 경기지방 경찰청 소속 경찰관 중 민간조사 분야와 밀접한 관련성을 가지고 있는 미아찾기특별반, 여성청소년계, 생활질서계, 교통사고조사계에 근무하는 총 57명을 심층면담 기법을 사용하여 민간조사업체의 증가원인과 그에 따른 문제점을 조사하였다. 면담내용은 비수량데이터 분석 소프트웨어인 NVivo 8을 활용하여 분석하였는데, 분석결과는 다음과 같다. 첫째, 민간조사업체의 증가 원인으로 사회의 변화 24(30.3%), 고수익성 15(18.9%), 수요의 확대 14(17.7%), 민간기관의 효과성 10(12.6%), 인구단위의 변화 8(10.1%), 범죄의 증가 8(10.1%)가 주요한 원인으로 범주화 되었다. 둘째, 민간조사업체의 문제점은 개인정보보호의 문제와 법제적 문제 그리고 운용적 문제로 나누어졌는데, 개인정보보호와 관련된 문제로서는 개인정보 유출 21(44.6%), 사생활 침해 17(36.1%), 개인정보 악용 9(19.1%)이 가장 큰 문제점으로 범주화 되었고, 법제적 문제로서는 민간조사업체의 불법행위 18(40.0%), 관리감독 15(33.3%), 법적근거 미비 12(26.0%)가 가장 큰 문제로 범주화되었다. 그리고 운용적 문제로는 민간조사업체의 비전문성 38(71.6%), 경찰과의 협력 결여 15(28.3%)이 가장 많이 거론되어 범주화되었다.

This study has utilized an in-depth interview method to examine the cause of an increasing number of private investigator agencies and its subsequent issues. 57 employees working in the divisions related to the field of private investigation at the Seoul Metropolitan Police Agency and Gyeonggi Provincial Police Agency are interviewed; a special division established to find lost children, women and adolescents division, public order division, and traffic accident investigation division are included. The content of the interviews are examined by using NVivo 8-an analysis software for qualitative data-and the following results are obtained. First, different changes taken place in society 24(30.3%), high profitability 15(18.9%), increase in demand 14(17.7%), effectiveness of private agencies 10(12.6%), change in populations 8(10.1%), increase in crime 8(10.1%) are mentioned as the major factors causing the expansion of private investigator agencies. Second, personal information protection, issues related to legislation, and ineffective management are thought to be the three main problems of private investigator agencies. Specifically, leakage of personal information 21(44.6%), invasion of individual privacy 17(36.1%), and misuse of personal information 9(19.1%) are considered as the biggest concerns of the issue related to personal information. Also, in the category of issues in regard to legislation, illegal activities of the agencies 18(40.0%), ineffectual supervision and management 15(25.8%), and lack of legal basis 12(26.0%) are pointed out. Furthermore, lack of expertise 38(71.6%) and little cooperation from the police 15(28.3%) are two main components of the weakness related to management of the agencies.
