학교폭력 정책에 관한 연구

A Study on School Violence Policy

금년 대구ㆍ경북지역에서 8명의 학생들이 학교폭력으로 자살을 하였다. 국민들은 경악을 금치 못하였고, 학교폭력은 사회문제로 대두되었다. 교육과학기술부, 시ㆍ도교육청 및 지역사회는 학교폭력을 예방하기 위해 수년 전부터 관련 정책을 추진하였다. 정부는 소년법과 초ㆍ중등 교육법이 있음에도 학교폭력 예방을 위하여 2004년 1월 29일 학교폭력 예방 및 대책에 관한 법률을 제정하였다. 시ㆍ도교육청은 학교폭력 전담부서를 설치하고, Wee 프로젝트 추진, 대안교육 위탁교육기관 지원, 교직원 대상 학기별 1회 이상 학교폭력예방연수 의무화, 배움터 지킴이 배치, CCTV 설치, 전문상담교사 배치, 친한 친구 교실 등을 운영하였고, 지역사회는 원스톱지원센터 설치, 피해학생 서포트 제도 등을 지원하였다. 금년에는 학교폭력 피해실태조사, 생활기록부 기록, 복수 담임제 실시, 체육수업의 확대, 전문상담사 확대 등의 제도를 추진하고 있다. 이와 같이 법률과 정책이 추진되고 있음에도 학교폭력은 사회문제로 확대되고 있다. 즉, 교육과학기술부에서 일괄적으로 추진하는 정책과 시ㆍ도교육청에서 자체적으로 실시하는 정책 등으로 혼재되어 일선학교와 소통이 원활히 이루어지지 않았음이 분명하게 보인다. 정책은 ‘지속가능성’과 ‘활성화’에 있다고 사료되는바, 지금까지 추진해오던 학교폭력 정책 중 문제점이 발생하면 회의 및 토론회를 거쳐 수정되어야 한다. 나아가 ADHD와 같은 정신적 질환을 앓고 있는 가해학생에게 맞는 맞춤형 교육인 ‘재활학교’ 설립과 학교 현장에서 절실히 요구되고 있는 ‘배움터 지킴이’제도 확대는 시대적 흐름이다.

This year, eight students decided to kill themselves due to the violence in Daegu and Gyeongbuk provinces. People were greatly shocked that school violence has become a social problem in korea. The Ministry of Education, Science and Technology, and the Department of Education has promoted several relevant policies in order to prevent school violence for the past few years. The government enacted the Juvenile Act and the Elementary and Secondary Education Act for the Prevention of School Violence on January 29th, 2004 as a law to prevent school violence. The Department of Education has created a special department to address the problem of school violence, call the Wee project, It supported alternative education, Also, teachers must attended seminars on school violence prevention, The schools installed CCTV, The school hired professional counselors and school police. And the schools will do many other things. Schools are promoting these laws, because school violence is becoming a bigger social problem. In other words, it is clear that the policies promotes by the Ministry of Education, et al, will try to do this smoothy with good communication with schools. If there are more problems with school violence, policies must be made though meeting and discussions. Furthermore, if a student suffers from a mental illness such as ADHD, the school should try to help that student with treatment.
