외국사례를 통한 민간조사제도 도입에 관한 연구

매년 우리나라에서는 수 많은 어린이가 미아가 되어 많은 부모의 마음을 아프게 하고 있다. 특히, 미아발생은 한 가정을 파탄에 이르게 하여 사회에 큰 문제로 지적되고 있다. 미아 뿐 만이 아니라, 지체장애인, 부도덕한 사기꾼, 기타 사유 등으로 인하여 행방불명이 되는 인구가 지속적으로 증가하고 있는 추세이다. 이러한 문제점에 대해서 경찰을 비롯한 각 기관에서는 전담인력 배치, 외국의 전문제도 도입 등과 같은 문제해결 및 예방을 위한 방법을 동원하고 있으며, 최근에는 통신기술을 활용하여 사람 찾기가 과거에 비해 효율적으로 개선되었으나, 그럼에도 불구하고, 과거에 비해 행방불명인의 숫자는 줄어들지 않고 있는 실정이다. 게다가, 최근 증가하고 있는 범죄 등으로 인해, 제한적인 인력을 가지고 있는 경찰에서는 이러한 행방불명 사건에 전력을 투구할 수 없는 상황에 도달하게 되었다. 행방불명 사건뿐만 아니라, 민사사건의 증가, 보험사기의 증가, 기타 조사업무의 증가 등으로 인한 외부적인 영향과 경찰인력의 부족, 자료 접근의 어려움, 전문성의 부재 등과 같은 내부적인 영향으로 인해, 경찰의 업무를 대신 수행하기 위하여, 민간조사업의 수요가 점점 증가하고 있는 실정이다. 그러나 현재 우리나라의 민간조사업은 관련법이 아직 국회에 계류되어 있지 않는 등 여러 가지 문제로 인해 실행되지 않고, 음성적으로 ‘심부름센터’ 등을 통해 활개치고 있어 문제가 되고 있다. 이러한 문제에 대해서, 이 연구에서는 외국의 선진사례를 바탕으로 민간조사제도 도입에 대한 기대와 실행방안에 대한 연구를 실시하였다.
