다문화시대의 범죄예방을 위한 사법정책변화에 관한 연구

A Study on Change of Criminal Justice Policy For Crime prevention in Multi-Cultural Age

우리사회에서 다문화주의는 흔히 접하게 되는 용어가 되었다. 1990년대 이후 고용허가제도의 도입을 통한 이주노동자의 증가와 국제결혼을 통한 결혼이주민의 증가로 이미 다문화시대를 맞이하고 있다. 다문화주시대는 2000년대 이후로 급속한 팽창을 보이고 있으며, 이러한 시대적 상황에 맞추어 각 정부부처에서는 다양한 대책방안을 마련하여 실시하고 있다. 즉, 다양한 문화를 흡수하고 소통할 수 있는 교육, 환경조성 등에 막대한 국가예산이 배정되어 사회통합을 유도하고 있다. 그러나 다문화주의를 받아들인 모든 나라들은 인종갈등을 비롯한 사회문제로 인한 고통을 받고 있다. 우리나라 경찰청 및 행정안전부를 비롯한 각 관련기관과 다문화가정을 지원하는 시민단체에서 시행되는 외국인 범죄예방교실, 외국인 관련 각종 지원정책을 마련하고 있으나, 우리사회의 미래를 이끌어 나갈 다문화가정 청소년에 초점을 맞춘 사법정책 및 범죄예방정책은 전무한 실정이다. 청소년의 비행이 부정적인 성장과정(가정해체 및 결손, 인종차별 등)에서 형성되는 가치관의 발현이라는 것은 많은 선행연구에서 밝혀진바 있으며, 이에 대한 대비책이 절실하다고 생각된다. 본 연구에서는 다문화가정 청소년의 범죄예방을 위해 청소년비행과 관련되는 선행연구를 검토하고, 우리나라 사람들의 인종적 차별에 대한 인식도를 살펴보았으며, 이를 바탕으로 다문화가정 및 다문화가정 청소년에 대한 환경과 추이를 살펴보았다. 이를 토대로 하여 다문화가정 청소년에 대한 범죄예방을 위해 몇 가지 제언을 하였다. 첫째, 다문화가정 청소년과 범죄와의 관계를 추론하여 대책을 강구하도록 요청하였으며, 둘째, 다문화가정 해체현상을 방지하기 위한 국제결혼 인증제도의 도입, 셋째, 경찰 및 형사사법기관의 전담부서의 설치, 넷째, 다문화 및 인권교육의 확대실시, 다섯째, CYS-net을 활용한 다문화가정 청소년들의 선도 및 계몽, 마지막으로, 복지정책에서 범죄예방정책의 지원으로의 변화가 필요하다고 지적하였다.

The multiculturalism is a common word in this society now. Since the employment permit system had been introduced in 1990s and increasing international marriage brings more migrants and which accelerating the multiculturalism. The multiculturalism has been expanding rapidly since 2000 and government organizations come up with effective plans for dealing with the situation. The plans are aimed for education and build infrastructure to emerge and communicate with various cultures. However, all countries which accepted multiculturalism have suffered various social issues due to racial tension. Community and government organizations including Korea Police and Ministry of Public Administration and Security run various multiculturalism supporting policies but there are no justice policy and crime prevention policy for multicultural families youth. Many previous studies shows that negative process of growth such as eliminating the family, broken home, and racial discrimination leads juvenile delinquency and preparations are needed. This study investigates a pilot study about preventing juvenile delinquency and a survey on perception level of racism among Korean. Based on these studies, inquire into the environment and development of the multicultural family and teenagers. This paper proposes several suggestions for prevent juvenile delinquency from multicultural family. First of all, investigate a connection between multicultural teenagers and juvenile delinquency for take measures. Secondly introduce the international marriage validation program to prevent eliminating multicultural family. Thirdly form a multicultural task force in police or the machinery of law. Fourth, expand multi-cultural and human rights education. Fifthly guide multi-cultural teenagers into the right path using by CYS-net. Lastly shift from social welfare measures to crime prevention policy.
