Is 'the whip of love' still worth it?: Controversies over the ban of physical punishment in Korea

“사랑의 매”는 아직 유효한가?: 학교체벌 금지 논란에 대한 비판적 고찰

본 논문은 최근 우리사회에서 논란이 되고 있는 학교에서의 체벌(physical punishment)금지의 문제에 관하여 논의하고자 한다. 본 논문은 이 문제를 전통적으로 우리나라의 학교교육 현장에 통용되어 왔던 훈육의 한 방편으로서의 체벌에 대해 비판적인 관점에서 논의하고 있다. 이를 위해 본 논문은 우선 체벌금지 정책의 등장배경을 정리하고, 체벌이 가진 훈육전략으로서의 성격에 대한 사회적 논란을 소개하며 분석하고자 한다. 이어서 한국의 학교교육에서 체벌금지법과 학생인권법의 도입이 어떤 정당성에 근거하고 있는지를 논의하고자 한다. 이러한 논의를 바탕으로, 학교교육에서 체벌의 형태로 나타나는 일종의 ‘폭력성’을 극복하고 그와 동시에 학교에서 관용의 문화를 회복하기 위한 방안에 대해 논의하고, 더 나아가 학교문화에서 교사의 권위와 책임의 역할을 회복시키며, 학생들을 보다 교육적으로 훈육할 수 있는 전략의 방향에 대해 논의하고자 한다.

This paper investigates the recent struggles in Korean society over the issues of physical punishment. Through a discussion of the controversies over the prohibition of physical punishment in public schools, this paper argues that a culture of violence has been prevailing in Korean schools along with the aged tradition of physical discipline both at home and at school. To highlight this argument, this paper, first of all, discusses the background of anti-physical punishment measures and introduces and analyses the debates on the identity of physical punishment in terms of disciplinary strategy. Then, this paper discusses the rationales of implementing the Anti-physical Punishment Law and Students' Human Rights Acts in Korean schools. Based on this discussion, this paper stresses that in order to overcome this culture of violence and to restore a culture of tolerance, it is necessary to nullify the power hierarchy and strengthen teachers' responsibility and authority. Finally, alternative strategies of adopting effective discipline and promoting students' learning are discussed.
