국민주권 실질화 방안으로서의 국민소환 제도

Recall System as a Measure for Realization of Popular Sovereignty

현행 우리 헌법 제1조는 ｢대한민국의 주권은 국민에게 있고, 모든 권력은 국민으로부터 나온다.｣라고 규정하여 국민주권을 선언하고 있고, 우리나라는 국민주권을 구현하기 위하여 대의민주주의를 채택하고 있다. 대의민주주의란 국민이 선거를 통하여 대표자를 선출하고, 그 대표자로 하여금 통치를 담당케 하는 제도이다. 그런데, 현대 대의민주주의는 본래의 기능을 잃고, 대표자가 국민의 의사를 제대로 반영하지 못하고 왜곡 운영되고 있다는 비판을 받고 있다. 즉, 현대 대의민주주의는 국민의 의사가 반영되는 것이 실질적으로 차단되어 있어, 대의민주주의를 통해 추구하고자 했던 국민주권실현의 의미는 많이 퇴색되었다는 비판이 있는 것이다. 대표자는 국민으로부터 위임받은 권력을 남용해서는 아니 되며, 자신을 뽑아준 국민을 두려워해야 한다. 그러려면 국민 스스로 무서운 존재가 될 수밖에 없고, 무서운 존재가 되려면, 영향을 미칠 수 있는 제도적인 뒷받침이 있어야 한다. 그래서 이제 국민은, 무엇인가 강렬한 제도 변화를 통하여 국민주권을 직접 행사하기를 바라고 있다. 그렇다고 대의민주주의를 포기하고 직접민주주의를 전면적으로 선택할 수는 없지만, 직접민주주의의 일부 제도를 도입하여 작금의 대의민주주의의 위기를 극복하고자 하는 것이다. 그 대표적 제도로서 국민소환 제도를 도입하는 것을 위기극복방안으로 제시하였다. ‘국민소환’ 제도는 국민이 대표자를 임기 만료 이전에 해임시킬 수 있는 제도로, 대표자가 국민의 뜻을 거스르는 행위를 할 경우 국민들이 투표로서 대표직을 박탈시키는 것이다. 이는 국회활동의 합리적인 정도를 넘어서는 폭력, 부정, 부패를 저지르는 자에게 국민의 힘을 보여줌으로써 대표자로 하여금 대표자로서의 정치적 책임을 다하라는 의미를 전달 할 수 있다. 즉, 국민소환 제도는 오로지 피치자에 머물렀던 국민을, 주권자로서의 지위로 회복시켜줄 수 있는 것이다.

Article 1 of the Constitution of the Republic of Korea reads “The sovereignty of the Republic of Korea shall reside in the people, and all state authority shall emanate from the people” which declares popular sovereignty. Representative democracy is adopted in order to implement popular sovereignty in the Republic of Korea. Representative democracy is a system in which citizens elect an individual, giving the elected person authority to represent within the government on their behalf. However, the modern representative democracy today has been criticized for its distortion; the original intention of the system is no longer being pursued and the representatives have failed to reflect the wants and needs of the people. Representatives should respect citizens who are the source of the power and therefore should not abuse their entrusted power. For the representatives to perform what they were chosen for more dutifully, there must be some kind of a new political system established. To compensate the shortcomings of representative democracy, some parts of direct democracy should be adopted as alternatives and that is Recall System. Recall enables citizens to vote and dismiss representatives before his/her term terminates who fail to meet the public’s want. It shows the power of citizens to those representatives who commit great offense, violence and corruption and also it works as a reminder how and by who they are selected and what their duties are as representatives. Therefore, Recall system restores the status as the ruler to people those who have remained the ruled.
