미국의 경제위기와 헌법규범적 · 법제적 대응에 관한 소고

A Study on the Constitutional and Legislative Measures against the Economic Crisis of the United States

세계 각국은 경제위기에 즉응하여 먼저 경제위기의 문제점들을 되짚어 보고 반성하며, 나아가 앞으로 지속적으로 겪게 될 경제적 곤란과 위기의 상황에 대비하고 있다. 본 논문은 이러한 위기상황에 대처하기 위한 거시적인 관점에서의 헌법규범적 접근과 더불어 헌법의 이념들을 실현하기 위한 관련 하위 법제도적인 해법을 찾고자 하는 노력에 주목하여, 지금껏 나름 가시화된 결과들을 살펴보는데 그 목적이 있다. 이러한 상황에서 미국에서 시작된 금융위기사태에 대한 규범적이고도 법제적인 해법을 찾아보고 나아가 국가의 재정을 튼실하게 하는 헌법규범적 토대 혹은 방안에 대해 고민해 보는 것은 큰 의미가 있다. 또한 경제위기 상황의 대처에 즉응하여 시행된 관련 법제도들 혹은 정책들의 내용이 통일적이지 않고 미봉책에 불과하거나 현세의 문제를 차세대에 떠넘기는 형식의 대처방식이 되어서는 안된다. 이러한 문제의식을 가지고 경제위기의 관리 내지 대응의 법제적 관점을 조명해본다. 본 논문에서는 첫째, 미국 정부가 진행하여온 경기부양정책과 금융개혁법안들을 분석하고 평가한다. 둘째, 미국은 적자재정을 감수하면서까지 대대적인 경기부양정책을 실시한 여파로 인해 심각한 재정곤란을 겪고 있다. 따라서 재정건전성을 확보하고 재정적자를 감소시킬 목적으로 시행되고 있는 균형예산의 헌법규범적 함의와 법제화에 대해 살펴본다.

Confronting the world-wide economic crisis, each country has been reflecting and reviewing the problems that have been occurred and trying to prepare to cope with the economic puzzles and crisic situations. In this regard, this study focuses on the efforts to address and solve the economic crisis and to find out the legislative measures to accomplish the constitutional ideologies, approaching the crisis from the macroscopic view point. Furthermore, this study aims at finding the meanings of the legal or normative solutions of the financial crisis arisen from the United States, and finding the constitutional foundation to strengthen the national fiscal soundness. It is not desirable only to apply temporary and capricious measures to solve the economic crisis, but also unhappy to shift the current problems onto the future generations. with this critical mind, this study sheds light on the legislative measures applied to the management of economic crisis. Specifically, first, this study deals with the financial reform acts and the economic stimulus policies that have been proceeded by the federal government of the United States. Secondly, this study examines the constitutional implications and the legislations of the balanced budget policies to decrease the fiscal deficit and to secure the fiscal soundness.
