UN국제전자계약협약(UN CUECIC)의 비준제고에 관한 연구

A Study on Enhancement of United Nations Convention on the Use of Electronic Communications in International Contracts

UNCITRAL은 국제무역법을 조화ㆍ발전시킬 목적으로 국제계약과 관련된 각종 협약과 모델법 등을 제정하여 왔다. 이러한 노력의 일환으로 2005년에 전자통신기술 등을 활용한 전자계약의 법통일과 예측가능성을 제공하기 위해 “국제계약에 있어 전자적 의사표시의 이용에 관한 UN협약”을 제정하였다. 본 협약은 2013년 3월 1일부터 정식으로 발효될 예정이다. 그러나 아직까지 동 협약에 대한 비준한 국가들이 많지 않은데 현재 싱가포르, 온두라스가 비준하고 도미니카 공화국만이 가입했다. 따라서 본 연구에서 동 협약의 비준이 제고되지 않는 문제점을 알아보고, 그 해결방안을 모색함으로써 전자계약협약의 비준을 제고하여 본 협약의 비준제고에 기여하고자 하는 것을 그 연구목적으로 한다.

United Nations Commission on International Trade Law(UNCITRAL) has been legislating a number of conventions and model laws relating international contracts and trade law for the harmony and development of international trade law. In 2005, UNCITRAL established United Nations Convention on the Use of Electronic Communications in International Contracts(UN CUECIC) for providing electronic contract’s law unification and predictavility in electronic contracts. UN CUECIC is going to entry into force on 1 March 2013. However, because there is a few nations ratified UN CUECIC, that is, two nations such as Singapore, Honduras ratified the convention and the Dominican Republic acceded that in 2012. Therefore, the purpose of this study is to cotribute to the activation of the UN CUECIC by studying the problems and solutions with regard to situation that UN CUECIC has not been ratified by many nations around the world.
