The Basic Rights of Labor for Individuals with Significant Disabilities

본 논문은 중증장애인의 노동기본권 확보 방안을 마련하기 위한 연구로 이 문제에 있어서는 UN을 비롯한 ILO와 같은 국제단체나 각국의 기본 법률에서 노동기본권과 필요한 행동계획을 제언하였지만 각국의 실상에서 이 기본권의 확보는 많은 차이가 있다. 따라서 국제사회의 협약이나 규칙, 각국의 법률에서 나타난 노동기본권 실태를 토대로 개선방안을 제시하기 위한 연구이다. 결과적으로 중증장애인의 노동기본권을 확대하기 위한 방안은 가장 먼저는 중증장애인의 노동권을 사회적 자본(social capital)으로 인식하는 것이 필요하겠지만 이외에도 각국의 헌법(시민법)에 노동기본권을 보장하는 조치들이 규정될 필요가 있고 중증장애 기준에 대한 재정립, 노동시장변화에 대한 국제연대, 전통적인 장애인 직업재활 방법의 변화, 중증장애인의 근로조건 기준 마련, 직업재활서비스의 우선권 부여, 적극적인 직무개발 및 배치, 정당한 편의제공방안 마련, 장애인을 위한 사회적 기업의 확대 등의 대안들이 마련되어야 할 것이다.

Though UN and International Labor Organization suggested a range of rules and action plans to secure basic right to work for people with significant disabilities through Convention on the Rights of Persons with Disabilities and the other conventions and recommendations on vocational rehabilitation, the extent of basic right of work widely differs in many countries. Thus, this paper aims to securing the basic right to work for people with significant disabilities must be based on a fundamental consensus rather than recommendation or rules of the international society. the first thing required is to recognize their right to work as social capital. On top of that it is necessary to include provisions that ensure their basic right to work in national constitutions. Other actions and plans highly needed include re-defining the criteria of significant disabilities, international cooperation to respond changing labor market, change in the conventional vocational rehabilitation of people with disability, setting up working conditions for people with significant disabilities, guarantying preferential right for vocational rehabilitation service, active job development and placement, provision of reasonable accommodation, and expansion of socially responsible corporations for people with disability.
