이명박 정부 정치영역에서의 헌법적 평가

Critical Evaluation on the Lee Myung-park Government in the Field of Politics

헌법은 정치법으로 성격을 지니며, 헌법에서 규정하고 있는 국민주권, 권력분립, 정치적 기본권, 정당정치, 지방자치가 그 요소에 해당한다. 헌법은 정치영역에 대해 권력통제, 정치적 공감대 형성, 정치적 정의실현 기능을 담당한다. 이러한 헌법의 기능은 헌법재판소에 의해 구체화된다. 이명박 정부는 2008년 국민에게 경제성장의 약속을 하며 출범하였으나, 점차 정치적 인기를 상실하여 사실상 중간평가였던 2010년 제5회 지방선거에서 야당에게 패하고 말았다. 선거후 이명박 정부는 친서민, 친중소기업 정책을 펼쳤다. 그 결과 2012년 4월 국회의원 선거에서 집권당이 승리하였다. 이명박 정부는 정치적 기본권보호에 소홀하였다. 정치적 사건들에 있어서 무리한 기소가 있었고 이에 대한 법원의 무죄판결이 이어졌다. 언론의 자유와 집회의 자유에 대한 과도한 정부의 규제는 헌법재판소의 합리적 결정으로 정치적 평화를 되찾게 되었다. 이는 헌법재판의 정치적 평화기능을 확인하는 좋은 계기가 되었다. 정당정치도 중앙집권적인 구습을 버리지 못하고 민주적 운영이 이루어지지 못하였고, 이러한 이유로 지방선거에서 민주적이지 못한 정당공천의 폐지의 목소리가 높았다. 이명박 정부는 우리 헌정사에 나타난 권위시대를 제대로 청산하지 못하고 또한 민주정부의 민주화정책을 승계하지도 못하면서 또한 독자적 제3의 대안도 제시하지 못하고 마무리 되었다. 이러한 헌정사적 한계는 향후 전개될 2013년 새로운 정부에게 그 극복의 과제를 부여하고, 우리에게 헌정사적 반성과 숙고의 계기가 되고 있다.

The Constitution has character of political law, it prescribes principle of sovereignty, division of powers, political civil rights, party politics, local self-government autonomy as elements of political law. The Constitution serves many important functions in politics : the power control, political consensus-making, bringing political justice. All this functions are fulfilled by the constitutional court. In 2008 Lee Myung-park government has begun working with promising economic growth, but has lost peoples political trust, and faced defeat in 2010 local election. After election defeat the Lee Myung-park government has changed political strategy in pro-working classes, pro-small and medium-sized businesses, and has won the parliament election in 4. 2012. Lee Myung-park government has neglected towards protection of political rights. In many political cases innocent persons were prosecuted, but the court and the constitutional court have dismissed the charges. In period of Lee Myung-park government the restrictions on the free speech and assembly were severe, the constitutional court has declared some that kinds of regulations as unconstitutional for bringing political stability. Political party system in korea has been criticized since it has led undemocratic operating, and for this reason people has wanted to abolish party nomination in local election. Lee Myung-park government has failed to get rid of authoritarianism, to maintain democratic policy of previous regime, and to suggest alternatives. This political experience during the Lee Myung-park government period gives us chance to have political self-reflection and deliberation.
