A Study on the Applicability of the CISG in CIETAC Arbitration

China adopted the CISG on 11 December 1986. With the continuingly fast growth of Chinese economy and China's proactive participation in international trade and commerce, massive cases as well as arbitral awards have been decided under the CISG in China. China should regulate the status and force of international agreements in Chinese legal systems by our constitution in order to perform international agreements' obligations. It undertakes a close examination of CIETAC decisions interpreting the United Nations Convention on Contracts for the International Sale of Goods which has been in effect in China since 1988. So, This article is to review the current law and practice in the PRC in the application of the CISG. There is an abundance of CIETAC(China International Economic and Trade Arbitration Commission) awards on the CISG.
