Modern Administration and Legislative Power of Local Ordinances

The Article §117①, the Constitution of Republic of Korea provides the right of self-government for local self-governing bodies to deal with inclusive affairs at their own responsibility. Moreover, this provision gives the effectiveness to local self-government by assuring the self-governing legislative power. It also assures self-governing legislative power for local assemblies and allows them to enact local ordinances. The enactment of local ordinances is important as much as associated with promotion of local self-government. Particularly, it is necessary to reset the limitation in legislative power of local ordinances for the benefit of local promotion, since the limitation is directly associated with facilitating local ordinances. Based on such needs, this paper came to examine the modern administration and legislative power of local ordinances.
