Comprehensive Countermeasures for Strengthening of the Victim Support

On the current law, criminal victims do not have enough participating-rights to a criminal justice procedure, they have much possibility of suffering 2nd damage from criminal investigation and trial process, and it is hard to expect restitution of victim damage. Therefore, The Ministry of Justice prepared the comprehensive countermeasures for strengthening of criminal victim protection/support which are contained establishment of the Basic Victim Right act, positive support for victim support center, and strengthening of the law support operating to the victim, etc. The concrete contents are as follows. First, for the victim's participating expansion to a criminal justice procedure, ① expansion of a notice system to a criminal victim, ② organization of Victim-Support-Division in all District Central Prosecutor's Office, ③ reform of the control system to non-prosecution action, ④ strengthening of the victim's statement right, ⑤ preparing of the right notice system for victims, etc. Second, for prevention of 2nd damage, ① preparing of the provision for protecting of a witness or an informant in trials, ② preparation of victim safe measure, ③ acception of the closed trials for victim protection, etc. Third, for the reform of compensation system, ① expansion of the criminal injuries compensation system, ② establishment of the Crime Victim Fund, ③ activation of the compensation order system, ④ introduction of criminal reconciliation system, etc.
