Victims Protection of Sexual Violence in Police Procedure

Through the establishment and revisions of laws about sexual violence crimes, the measures for the victims of sexual violence crimes have started to be arranged in Korea. However, still more in-depth discussions and researches on the application and effect of devices and system for saving and protecting the victims of sexual violence crimes are required. Especially, the second damage for the victim of sexual crimes occurring during the administration of criminal justice is leading to duplicate pain and scar for them. Although recently the investigation of sexual violence crimes are being carried out by exclusively assigned female police officers as the center, and the efforts to protect the victims are seen through methods such as the video statement for child sexual violence, still the current state is difficult for the victims to visit the investigation institution to report being the victim of sexual violence. This can be thought of as the general perception about the victims of sexual violence crimes which are still prevalent in our society. It can be found in the tendency where the sexual violence in our society is thought to be the problem of purity or chastity for the victim or believed to be an interest stimulating incident rather than regarded as a crime where sexual right to choose was violated or other person's human right was violated. With the establishment of Sexual Violence Special Laws, the attention for the victims which has been ignored and the development in the study of victims have been achieved by making issues out of sexual violence crimes which had been hidden without being publicized socially. However, although 10 years have passed since the establishment of Sexual Violence Special Laws, still the need for reinforcing inadequate aspects of protecting the victims is being raised. Therefore, in this paper, in regards to the protection system for the victims of sexual violence crimes during the police investigation process from criminal justice institutions, the current state and problems for our country are examined, and the effective and realistic ways of improvement are sought.
