서해 북방한계선(NLL)의 법적 문제와 평화적 해법

Legal Issues and Peaceful Solutions on the Northern Limit Line(NLL)

서해 북방한계선(NLL)은 정전협정 및 국제해양법상 그 타당성이 인정되기 어려운 선이다. 그것은 오히려 국제해양법상 허용될 수 있는 북한 12해리 영해를 침범하는 선이 될 수 있다. 그러나 북한이 관철하고 있는 동해 군사경계수역 및 동해 NLL 역시 타당하지 않은 선이며, 남한의 해양관할권을 제약하고 있다. 따라서 NLL의 해법으로 서해 북방한계선과 동해 북방한계선 및 북한의 군사경계수역을 같이 폐기하는 일괄타협이 가능할 것으로 생각된다. 공동어로구역 및 서해평화협력지대는 그 문제를 우회하는 해법으로 차선책이라고 할 것이다. 나아가 남북 상호 무해통항권의 보장은 한반도 해상의 군사적 긴장을 완화하는 기초적인 조치가 될 수 있을 것이다. 그러나 어떠한 해법이라도 NLL의 법적 본질에 대한 올바른 인식이 전제되어야 한다.

This is a study to examine whether the NLL(Northern Limit Line) is valid or not and what will be the reasonable solution about the disputes on the NLL. This thesis maintains that the military enforcement of the NLL contravenes the international law and/or the Korean Armistice Agreement of 1953. In other words, the NLL cannot be a proper border line between South and North Korea, nor the NLL is a valid military demarcation line under the Korean armistice regime. This paper suggests a couple of solutions to the NLL issue; first, the simultaneous abolition of NLL on the South side and the military zone on the North side, second, the establishment of common fishery and peaceful cooperation zone, third the mutual guarantee of the innocent passage.
