A Study on Legal Practices of Parties Concerned in Transferable Credits

Nowadays Documentary credits in international trade is very useful and important payment systems because of stability of proceeds settlement among all parties concerned. At the same time, according to increasing of import and export, a more popular method of financing the supply transaction is the practice of making a credit transferable. The letter of credit itself is not negotiable in the sense in which a bill of exchange or another negotiable instrument can be transferred to another person. The transfer of the credit means that the seller transfers the rights and at least certain of the duties arising under the credit to another person, usually his supplier. In this respect, the purpose of this study is to analyse the transfer of documentary credit in the practical and legal aspect, and to explore the problems arising from adopting concerned parties of transferable credits. In addition, it is intended to suggest several implications in banking and trade field. I hope that this study will be helpful for the understanding of commercial credit transaction.
