A Study on Scope of Application under the TBT Agreement

The purpose of the TBT Agreement is to prevent technical regulations, standards and conformity assessment procedures from obstacles to trade. At the same time, this Agreement seeks to strike a balance between free trade and the sovereign rights of the World Trade Organization Members to restrict trade in order to pursue legitimate policy objectives, such as protection of human health and safety or environment. Through the reports in three disputes in 2012, the Appellate Body provided important and controversial views regarding the interpretation of the TBT Agreement. Recent WTO cases showed a broad scope of the TBT Agreement through establishing the limits of technical regulations, providing further understanding of standards and inclusion of process and production methods(PPMs) under the TBT Agreement. First, paper intends to explore that definition of technical regulation and standard of TBT Agreement. Second, paper deal with issue such as the process and production method debate.
