Human Rights in North Korea: International Pressure and Its Effects

북한인권에 대한 국제사회의 관심과 개선을 촉구하는 다양한 압력이 지속되고 있다. 2013년 3월 유엔인권이사회 결의안에 기초하여 북한인권 유엔조사위원회(Commission of Inquiry: COI)가 설립되어 활동하고 있다. 유엔조사위원회는 9가지 북한인권침해 유형에 대한 최종보고서를 유언총회에 제출할 예정이며, 책임지에 대한 형사소추를 건의할수 있다. 유엔에서 북한 인권문제가 제기되는 중요한 이유는 체제실패에서 비롯된 만성적 기아와 자유권을 심각하게 제한하는 유일지배체제 때문이다. 핵위기는 미국을 비롯한 서방세계가 북한인권문제를 외교적 카드로 개입하게 만드는 전략적 요인이 되고 있다. 유엔조사위원회 활동결과 북한에 대한 추가적인 제재가 실현될 가능성은 매우 희박하지만, 북한 인권침해에 대한 최종적인 책임자로 북한지도자를 지명하고 처벌을 요구한다면 북한체제의 정통성과 권위는 큰 타격을 받게 될 것이다. 북한에 대한 국제사회의 인권압력은 북한 인권개선을 위한 독립변수가 될 수는 없다 하더라도 장기적으로 북한내부의 정치 사회적 변화를 촉진하는 매개변수가 될 수 있다.

In the past 20 years, international community including the United Nation have expressed serious concern about the human rights situation in North Korea. UN has issued more than 60 reports, news briefings and resolutions regarding North Korean human rights. In 2013 UN established the COl(Commission of Inquiry) which has been mandated to conduct independent investigations and to provide the General Assembly with a written report in 2014. The commission might conclude that a Crime Against Humanity could be established in North Korean cases and recommend Security Council to transfer the cases to the international criminal justice, that could bring a fierce international criticism against current North Korean political leadership which would incur tremendous damage on its political legitimacy. North Korean human rights issue might be escalated in accordance with development of UN sanctions with regard to its nuclear and WMD (Weapons of Mass Destruction) programs. Adding on UN's human rights pressure, the international isolation of North Korea will be deepened and regime change solution also come up to the surface. Refusing any access from UN human rights entities and rejecting any allegations of massive inhumane treatment of its people, North Korea's harsh rollback to its old way of tight control of her people seems to be a wrong choice.
