A Comparative Study on the Direct Control of Parliament to Administrative Legislation

오늘날 행정입법은 행정기능의 확대ㆍ전문화 현상으로 인하여 행정입법의 다양성과 범람을 초래하고 있다. 행정입법의 다양성과 범람은 의회입법을 침식하고, 헌법의 기본원리인 삼권분립과 법치주의 원칙, 의회주의를 형해화ㆍ공동화시킴에 따라 행정입법에 대한 합리적이고 효과적인 통제방안이 요구되고 있다. 행정입법에 대한 합리적이고 효과적인 통제방안은 무엇보다도 입법의 본질적 기능을 수행하고 있는 의회의 직접적 통제이다. 그럼에도 불구하고 우리나라의 경우 아직 제도적으로 행정입법에 대한 의회의 직접적 통제가 제대로 이루어지지 않고 있다. 따라서 본고에서는 우리나라에서의 행정입법에 대한 이론적 일반론을 개관한 후 행정입법의 필요성과 한계를 살펴보고 외국의 주요국가와 우리나라의 행정입법의 직접적 통제를 비교 고찰함으로써 우리나라의 법 현실에 대하여 주목할 만한 시사점을 얻고, 장차 보다 적적할 행정입법의 통제방안을 모색하고자 한다.

Today, the administrative legislation has bring about flooding and various administrative legislation, result from expansion of administrative function and specialization. The flooding and various administrative legislation has erode to parliament legislation, has lose substance separation of legal, constitutionalism, parliamentarism of a basic principle of constitution. therefore be sought after the control way of effective and resonable to administrative legislation. Above all things the control way of effective and resonable to administrative legislation has direct control of parliament to carrying out essence function of legislation. Nevertheless do not carrying out properly the direct control of parliament to administrative legislation in Korea. Therefore, in this study, after these common theory has considerate to administrative legislation, has considerate necessity and limitation to administrative legislation. And so compare major foreign countries to Korea about the direct control of parliament to administrative legislation. It should has be preview point to laws administrative of korea and would be find to the control way of administrative legislation.
