The SPS is the agreement on how governments can apply food safety and animal and plant health measurements out the basic rules in the WTO. After joining the WTO, China's sanitary and phytosanitary regulations has been developed in many fields. However, comparing to the WTO agreement, there are also some immature parts in the measures. This paper compares China's sanitary and phytosanitary measures to SPS agreement so that shows some problems of China's ones and suggestions to solve these problems. The problems may cause disputes between China and other trading countries because the measures may use for unnecessary trade barriers. In conclusion, This paper provides some suggestions such as the strength of legal systems and the establishment of a unified management organization, the development of inspection technology, consistency with international standard, the improvement of risk assessment system, and transparency.
