Regulatory Budget: The Point at Issue, Exploratory Analysis for Application

규제예산(Regulatory Budget)은 모든 규제가 유발하는 비용에 상한을 두어 무분별한 규제의 양산을 통제함으로써 자원의 합리적 배분을 달성하는 것을 목적으로 하며 이론적으로는 강력한 규제개혁 수단으로 평가받는다. 그럼에도 불구하고 우리나라에서는 이론적으로나 실무적으로 규제예산에 대한 논의가 공론화된 바가 없다. 본 연구의 목적은 규제예산이 갖는 매력에도 불구하고 왜 제도화가 무산되었는지에 대한 의문에 기초하여 규제예산의 제도화 가능성을 탐색적으로 분석하는 데 있다. 본 연구에서는 편익측정의 배제, 비용추정의 신뢰성, 정책수단의 제약, 적정규모의 결정, 새로운 비용 유발 등 규제예산의 쟁점을 분석틀로 사용하여 제도화 가능성을 분석하였다. 분석결과, 편익배제를 제외한 여타의 쟁점은 역량 및 제도운영의 기술적 문제로 환원하여 해석할 수 있었으며 이는 다소 어려울 수는 있겠으나 제도화 과정에서 해결 불가능한 문제는 아닌 것으로 파악되었다. 결국 규제예산 제도화의 중심에 편익추정 배제의 쟁점이 자리하고 있었으며 이는 규제의 효율성과 형평성 간 선택의 문제로 귀결될 수 있다. 이러한 논의가 시사하는 바는 규제개혁 프로그램의 제도화에 있어서 효율성과 형평성 간 균형의 담보가 핵심적 고려사항이어야 한다는 것이다.

Regulatory budget aims at achieving rational allocation of resources by putting a cap at regulatory costs and constraining agencies from issuing ineffective regulations. Thus regulatory budget is theoretically considered as a powerful tool for regulatory reform. Nevertheless, there has been no public debate on Regulatory budget theoretically neither practically in Korea. This study aims at searching the applicability of regulatory budget on the basis of a question of why application of regulatory budget has failed despite its merits. This study examines the applicability of regulatory budget by using five disputed points(exclusion of benefit estimation, problems related to cost estimation, conditional selection of policy instrument, decision of proper size of budget, additional cost) as an analytical framework. We found that except exclusion of benefit estimation, all disputed points could be regarded as technical problems in implementing the regulatory budget and identified as solvable problems. We also found that exclusion of benefit estimation has been at the center of application of regulatory budget and regarded as a selective problem of regulatory value between efficiency and equality. This results suggest that programs or institutions for regulatory reform be designed to strike a balance between efficiency and equity.
