부동산거래 범죄의 대응방안에 관한 연구

A Study on Countermeasures of Real Estate Transaction Crime

모든 범죄에는 개별적인 특징이 있으며, 부동산거래 범죄는 지능성, 전문성, 모방성, 상호연쇄성, 영리성 그리고 피해의 심각성 등을 그 특징으로 하고 있다. 부동산거래 범죄의 이러한 특징은 실제 수사 현장에서 범죄성립 자체가 어려워지는 등의 현상을 초래하여, 결국 범죄자에 대해 국민의 법 감정에 상당하는 처벌이 이루어지지 않음으로써 사회전반에 걸쳐 부동산거래 범죄가 만연하게 되었다. 따라서 수사기관의 실체적 진실발견을 위한 효율적인 수사방안 등 부동산거래 범죄에 대한 포괄적인 대응방안이 절실히 요구된다 할 것이다. 부동산거래 범죄의 문제 해결을 위한 대응방안으로 부동산 관련법령의 실효성 제고안, 부동산 정책적 측면에서의 대응방안, 부동산거래 범죄 수사 방법적 측면에서의 대응방안을 제시하고자 한다. 모든 범죄수사에는 크고 작은 난관이 있기 마련이지만 특히, 부동산거래 범죄는 국민 개개인에게 직접적이고 실질적인 피해를 주는 것이므로 위와 같은 방안이 시급히 적용될 수 있도록 관계기관에서의 적극적인 조치가 뒤따를 수 있기를 기대해 본다.

In all crime has individual characteristics. And real estate transaction crime has features intelligence, professionalism, imitation, sequence of events, commerciality, and the magnitude of the damage. These are directly reflected to the actual crime scenes, which keeps them being proven crime. Eventually, criminals are not properly punished corresponding to citizens` appraisals, which leads real estate transaction crime to become rampant among society. Therefore, deterrent measures for real estate transaction crime are urgently required such as effective investigative plans to uncover substantive truth. I suggest proposals on improvement of effectiveness of the real estate legislation, policy, and the way of investigation as deterrent measures to address the problems. All crime investigation cases often go through difficulties, especially, real estate transaction crime causes direct and actual damages. I hope that the authorities take active steps in order for the measures above to be applied at the crime scene urgently.
