경찰서 유치관리 업무의 문제점 및 개선방안에 관한 연구

A Study on The Problems of Police Detention Management and How to Improve The Management

경찰서 유치장은 경찰관직무집행법 제4조에 해당하는 피보호 요건을 갖춘 자를 보호하는 보호실과는 달리 형사사법작용의 하나로써 체포나 구속된 형사 피의자나 피고인 등을 구금하는 장소로서 체포된 자나 긴급 구속된 자의 신병을 확보하기 위해 구속영장을 발부 받을 때까지 임시로 유치하는 시설로서의 기능과 대용감방으로서의 기능을 가지고 있다. 그러나 2012년 최갑복 사건을 비롯하여 유치장 관리에 대한 사회적 관심과 우려가 팽배해 있고 이로 말미암아 경찰에 대한 신뢰하락과 이미지에 대한 실추가 야기되고 있는 실정이다. 이에 따라 유치장 관리와 운영을 효율적으로 하고 인권침해 요소를 최소화 하기 위한 다양한 노력들이 이루어지고 있다. 그러나 유치장 업무는 유치인에 대한 인권보장과 효율적 관리와 더불어 유치근무자에 대한 환경개선과 만족도 향상이 선행되어야만 목적이 달설될 수 있다고 생각한다. 따라서 본 연구에서는 외국과 국내의 유치장 설치와 관리에 대한 문헌 고찰을 토대로 경찰서 유치업무에 투입되고 있는 경찰관의 근무환경, 만족도, 피로도에 대하여 부산지역 경찰관들을 대상으로 조사하였고 그에 따라 유치근무에 종사하는 경찰관의 애로사항을 토대로 업무상 문제점과 그에 따르는 개선방안을 도출하고자 하였다.

A police detention room is different from a protection room which protects such persons as are accommodated according to the stipulations in Article 4 of the Act on the Performance of Duties by Police Officers. A detention room is a place in which urgently arrested or captured criminal suspects or accused persons are temporarily confined by means of a criminal judiciary action till an arrest warrant is issued and which serves as a substitute for a prison cell. People's attention and concern about the management of a detention room have been high since 2012 when the Gap-bok Choi incident and others happened; and people's trust for the police has dwindled and images of the police have deteriorated. In this context, various efforts are being made to efficiently operate and manage detention rooms and minimize infringes upon human rights in there. However, a detention room can be efficiently operated and managed only when human rights of those in custody are properly secured and environments are satisfactorily improved for the workers at the room. At this juncture, based on relevant documents, this study is conducted into the establishment and management of detention rooms in Korea and other countries and into the working conditions and the degree of satisfaction and exhaustion of policemen who manage detention rooms especially in the Busan region, with a view to coming up with how to improve the difficulties and/or problems of the management of the rooms.
