경찰 공권력 수긍성 확보 방안에 관한 연구

A Study on Acceptance Measure of Governmental Authority of Police

경찰의 임무는 잠재적 혼란 또는 범죄로부터 침해당한 불안정한 질서를 회복하여 사회질서를 유지하고 국민이 안심하고 생활을 할 수 있도록 하는 것이다. 이에 따라 공공의 질서를 위하여 경찰권의 행사에 필요한 경찰기관과 경찰공무원은 국가의 필수적 요소이고 국민의 일반적 권리를 보호하고 국민에게는 없어서는 안 될 최소한의 안전과 권리를 지키는 직접적인 활동의 주체이다. 이러한 공권력행사에 대한 저항은 사회질서에 직접적 영향을 준다는 측면에서 매우 중요하게 다루어져야 할 것이다. 본 연구에서는 경찰공권력의 실추 원인과 사례의 분석을 통하여 경찰의 공권력 수긍성 확보방안에 대하여 논의하였다. 이에 따라 첫째로 공권력은 시민들의 동조와 인정으로 부터 확보할 수 있다는 것을 제안하였으며, 둘째로 상습적인 공권력 저항자에게는 엄중한 처벌을 제안하였다. 셋째로 공권력이 인권과 관련하기 때문에 강력한 사법처리의 부작용으로 경찰에 대한 앙심을 증가시킬 수 있다는 측면에서 채증위주의 교육 또한 방안으로 제시하였다.

A duty of the police is to maintain public order for safety life of people by recovering unstable public order due to potential perturbation and crime. Therefore, police department and police officer are essential element for the nation to keep public order and are the direct activity subject to keep minimum safety and right of people. Resistance against such governmental authority should be significantly treated since such resistance could directly influence upon the public order. In this study, acceptance measure of governmental authority of police has been discussed through case analysis and cause of loss on governmental authority of police. First of all, we suggested that the governmental authority would be secured by agreement and recognition of people. Second, harsh punishment was suggested toward habitual resister against the governmental authority. Third, since the governmental authority is directly related to human rights, strong judicial management could increase grudge against the police. Considering such possibility, an education on collected evidence is suggested as well.
