아동성폭력범죄 예방을 위한 대응방안 모색

A Study on the Countermeasures for Child Sexual Abuse's Protection -Focused on the Analysis of Case Study Abroad-

본 연구는 아동성폭력범죄 예방과 관련하여 우리나라에서 이미 시행되고 있는 여러 제도들을 내실화하고, 향후 아동성폭력범죄를 둘러싼 정책 방향을 보다 구체화시킬 필요에 의해 논의가 이루어졌다. 이를 위해 주요 선진국의 아동 대상 성폭력범죄 대응정책을 비교ㆍ분석한 후 시사점을 도출하여 아동성폭력범죄의 대응방안을 모색하고자 하였다. 본 연구에서는 미국, 영국, 일본의 아동성폭력범죄 관련 처벌법제, 아동성폭력범죄 예방정책 및 관련 프로그램, 성폭력 피해 아동 보호지원체계 등을 중심으로 주요 내용들을 살펴보았다. 해외사례분석을 통해 우리나라의 아동성폭력 예방을 위한 대응방안을 제시하면 다음과 같다. 첫째, 아동성폭력 예방을 위한 법률적 정비 측면에서는 유전자정보 등록제도에 관한 검토, 성폭력범죄자 거주제한 관련 규정의 확대, 법원 양형과정에서의 문제점을 해소하고 선고형을 강화하는 방안, 아동성폭력 범죄자 출소 정보고지제도 도입 필요성 등이 요구된다. 둘째, 아동성폭력범죄 예방정책 및 관련 프로그램 측면에서는 무엇보다 체계적 범죄관리시스템 구축이 요구된다. 셋째, 아동성폭력 예방을 위한 사회적 연계체계 강화 측면에서는 지역연대 활성화 및 방과 후 아동보호시설의 확대 및 체계적 관리가 필요하다.

The purpose of this study is the prevention of child sexual violence in South Korea that have already been implemented in several systems to be substantiality and future policy direction surrounding child sexual violence need more specific discussions have been made. For this purpose, this study is analyzed of the major developed countries' policy responses of child sexual violence, and derived countermeasures based on the suggestions. This study mainly examined of the United States, the United Kingdom, and Japan's child sexual violence punishable provision, child sexual violence prevention policies and related programs, sexually abused children's protection support system, etc. Countermeasures for the prevention of child sexual abuse through the case studies of abroad are the following: First, the various institutional measures(the legal review of genetic information registration system, the residential areas limit expansion of sex offenders, the resolve the problems in the process of the court's sentencing, and the released from prison information system of child sexual offenders) are needed. Second, systematic crime management systems were required in terms of child sexual violence's prevention policies and related programs. Third, local solidarity activations, expansion of after-school child care facilities and systematic management were required in terms of enhanced social connection systems for child sexual violence.
