Essential Facility and Foreclosure

본 연구에서는 필수설비에 대한 거래거절행위가 가지고 있는 경쟁배제 효과에 대해 살펴본다. 시장지배적 지위 남용의 한 유형으로 규제되는 필수설비에 대한 거래거절은 미국에서 판례법의 일부로 확립되어 집행되고 있고 국내에서도 그 사례가 발견된다. 필수설비에 대한 거래거절 규제는 통상 수직적 관계를 가진 기업들 간의 거래에 적용이 되는 것으로 알려졌으나 수평적인 관계를 가진 기업들 간에서도 적용이 되고 있다. 본 연구에서는 필수설비에 대한 거래거절 규제의 가장 중요한 성립요건은 관련기업들이 수직적 혹은 수평적인 관계를 가졌는가가 아니라 그들이 생산하는 제품들 간의 補完性(complementarity) 성립 여부임을 보였다.

This paper analyzes the anti-competitive effect of refusal to supply essential facility. Refusal to supply essential facility, which is a form of the abuse of dominance, has been established from a case in the U.S. and is also observed in Korea. Essential facility doctrine has been applied to cases among firms with horizontal relationship as well as vertical relationship. This paper demonstrates that the condition for the application of essential facility doctrine has to do mainly with the existence of complementarity among the products of the firms rather than with whether the firms are vertically or horizontally related.
