미국의 전략물자 규제에 관한 연구

A Study on the US Regulation of Strategic Items : Focusing on Reexport and Retransfer

Based on ITAR(International Traffic in Arms Regulations) and EAR(Export Administration Regulations), the US government requires any foreign stakeholder, irrespective of nationality and domicile, to obtain approval prior to the export or transfer of strategic items to interested parties of the third country. This extraterritorial jurisdiction has been recognized as a significant burden for Korea s commercial and governmental activities in strategic items trade, bringing concerns over its recent initiative to promote defense industry. Unlike previous researches which simply snapshot ITAR and EAR, this study is to analyze procedural requirements of ITAR and EAR for reexport or retransfer and get some academic and policy implications for Korea.
