일본 맨션표준관리규약에 관한 검토

A Consideration on the Standard Management Rules of Mansion in Japan

본 논문에서는 일본의 맨션표준관리규약에 내용과 최종 개정에 있어서의 포인트를 살펴보고 또한 최종적으로는 일본 맨션에서의 관리에 관한 현안을 검토함으로서 우리 집합건물 특히 공동주택에서의 표준관리규약에 어떠한 참고가 가능하며 또 이를 어떻게 투영시킬 것인지에 관해 고찰하였다. 건물의 새로운 재생의 한계가 분명히 존재하고 있는 문제는 또 다른 차원의 문제로 남겨둔다고 할 지라도, 현재 사용 중인 건물에 대해 그 사용의 가치를 극대화하는 의미로 표준관리규약의 필요성과 중요성은 크게 인식되고 있음은 주지의 사실이다. 더불어 최근에는 건물의 물리적 환경의 중요성이 크게 강조되던 기존의 문제와 더불어 건물의 사회적 환경도 크게 중요시되고 있다. 예를 들면 일조권의 문제, 조망이익의 문제가 그러하다. 생활방해의 범위의 확대화, 수인한도 범위의 축소화 등은 이미 우리 사회에서 이미 발생하고 진전되고 있는 문제이다. 여기에서 표준관리규약의 큰 새로운 사명이 발생한다고 생각되는데, 즉 구분소유자는 표준관리규약에 대해 주거하고 있는 아파트에 있어서 기존의 물리적 환경의 쾌적함을 중심으로 기대하고 있던 것이 이제는 사회적 환경의 쾌적함까지도 표준관리규약에 기대하게 되었다는 것이다. 바로 여기에 표준관리규약의 역할의 중요성이 있다 할 것이다. 일본의 표준관리규약에 대한 검토를 기초로 우리의 공동주택표준관리규약에서의 시사에 관한 연구가 계속해서 필요할 것이다.

This study examined the contents in the standard management rules of mansion in Japan and the point in the final revision and also figured out the pending issue on management in Japanese mansion finally, thereby having considered on which reference is available for the standard management rules especially in multi-family housing and also on how it will be reflected. A problem about which the limitation to new regeneration in a building is left as an issue in another dimension. Nevertheless, it is a well-known fact of being greatly recognized the necessity and the importance in the standard management rules as a meaning of maximizing value of its use on the building that is being utilized now. In addition, even the social environment in a building is being greatly emphasized these days along with the existing problem of having been greatly stressed the importance of physical environment in a building. For example, such cases include a problem of right to sunshine and a problem of advantage to view. The expansion in range of activity disturbance and the reduction in range of the limits to endurance are the problems of being already created and progressed in our society. The greatly new mission of standard management rules is thought to be created here. In other words, a unit owner had expected for the standard management rules focusing on comfortableness of the existing physical environment in condominium of being dwelled, but came to expect now for the standard management rules even in comfortableness of social environment. It will be able to be said that here is just the importance of a role in the standard management rules. A research on implication in the standard management rules of our multi-family housing will be continuously needed on the basis of a review on the standard management rules in Japan.
